  1                                        AN ACT
  2    RELATING TO SCHOLARSHIPS; AMENDING SECTION 33-4302, IDAHO CODE, TO PROVIDE FOR
  3        ADDITIONAL SCHOLARSHIP ELIGIBILITY, TO PROVIDE CONDITIONS FOR ELIGIBILITY,
  4        TO PROVIDE FOR THE INITIATION OF BENEFITS AND TO  MAKE  TECHNICAL  CORREC-
  5        TIONS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 33-4302, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        33-4302.  SCHOLARSHIPS -- STATE AID. (1) The following  individuals  shall
 10    be eligible for the scholarship program provided for herein:
 11        (a)  Any  dependent of any Idaho citizen who is a resident of the state of
 12        Idaho on or after the effective date of this act and who has  been  deter-
 13        mined  by  the  federal  government  to be a prisoner of war or missing in
 14        action or to have died of injuries or wounds sustained in action in south-
 15        east Asia, including Korea, or in Iraq or  in  Afghanistan  or  who  shall
 16        become  so  hereafter,  in  any area of armed conflict in which the United
 17        States is a party, shall; and
 18        (b)  Any dependent of any member of the armed forces of the United  States
 19        who  is  stationed  in  the  state  of Idaho on military orders and who is
 20        deployed from the state of Idaho to any area of armed  conflict  in  which
 21        the  United  States  is a party and who has been determined by the federal
 22        government to be a prisoner of war or missing in action or to have died of
 23        injuries or wounds sustained in action as a  result  of  such  deployment.
 24        Provided  further,  that such dependent must be a resident of the state of
 25        Idaho and must have completed secondary school or its  equivalent  in  the
 26        state of Idaho.
 27        (2)  An  eligible  individual who applies for the scholarship provided for
 28    herein shall, after verification of eligibility, receive the  scholarship  and
 29    be  admitted  to  attend  any public institution of higher education or public
 30    professional-technical college within the state of Idaho without the necessity
 31    of paying tuition and fees therefor; that such student shall be provided  with
 32    books, equipment and supplies necessary for pursuit of such program of enroll-
 33    ment not to exceed five hundred dollars ($500) per quarter, semester, intensi-
 34    fied  semester,  or  like  educational period; that such student shall be fur-
 35    nished on-campus housing and subsistence for each month he or she is  enrolled
 36    under  this program and actually resides in such on-campus facility; provided,
 37    however, that such educational benefits shall not exceed a total of thirty-six
 38    (36) months or four (4) nine (9) month periods.  Provided  further,  that  the
 39    initiation  of such educational benefits shall extend for a period of ten (10)
 40    years after achieving a high school diploma  or  its  equivalency,  or  for  a
 41    period  of  ten  (10) years after the event giving rise to the eligibility for
 42    the scholarship, whichever is longer.
 43        (23)  The dependent shall meet such other  educational  qualifications  as

  1    such  institution  of  higher  education or professional-technical college has
  2    established for other prospective students of this state.
  3        (34)  Application for eligibility under this section shall be made to  the
  4    state  board  of education and the board of regents of the university of Idaho
  5    or the state board of vocational-technical education. The board  shall  verify
  6    the  eligibility  of  the  dependent  and  communicate such eligibility to the
  7    dependent and the affected institution or college.
  8        (45)  Affected institutions shall in their preparation  of future  budgets
  9    include  therein costs resultant from such tuition, fee, book, equipment, sup-
 10    ply, housing and subsistence loss for reimbursement  thereof  from  appropria-
 11    tions of state funds.
 12        (56)  Applicants  for the scholarship program herein prescribed shall pro-
 13    vide institutional administrative personnel with documentation of their rights
 14    under this act.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 16854

Idaho Code currently provides a scholarship for dependents
of Idaho resident members of the military service who are killed
or missing during armed conflict.

This amendment extends scholarship benefits to those
dependents of members of the military who are killed or missing
in armed conflict, who are stationed in Idaho when deployed, but
were not residents at enlistment. To qualify for a scholarship,
the dependent must also be an Idaho State high school graduate.


                           FISCAL NOTE

The fiscal impact is dependent upon the total number of
Idaho's fallen heroes who give the supreme sacrifice to their
state and nation during the war in Iraq or other conflicts. 
Fiscal impact is expected to be $12,000 per student per year for
tuition, fees, room and board, and a stipend for books and
supplies.
