  1                                        AN ACT
  2    RELATING TO WORKER'S COMPENSATION; AMENDING SECTION  72-713,  IDAHO  CODE,  TO
  3        PROVIDE FOR SERVICE OF NOTICE OF HEARING BY FIRST CLASS MAIL.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION  1.  That  Section  72-713, Idaho Code, be, and the same is hereby
  6    amended to read as follows:
                                                                        
  7        72-713.  NOTICE OF HEARINGS -- SERVICE. The commission shall give at least
  8    ten (10) days' written notice of the time and place  of  hearing  and  of  the
  9    issues to be heard, either by personal service or by registered, or certified,
 10    or  first  class mail. Service by mail shall be deemed complete when a copy of
 11    such notice is deposited in the United States post office, with  postage  pre-
 12    paid,  addressed to a party at his last known address, as shown in the records
 13    and files of the commission. Evidence of service by certificate  or  affidavit
 14    of the person making the same shall be filed with the commission.

                      STATEMENT OF PURPOSE

To provide a more cost effective procedure that allows the
Industrial Commission to send notices of hearings by first class
mail.  First class mail is the service used by all the judicial
districts in the state of Idaho concerning the mailing of trial
dates, court orders, and decisions issued by judges.  Further,
first class mail is used by the Idaho Supreme Court to notify
parties in Supreme Court matters.  With claimants representing
themselves, the Industrial Commission schedules a telephonic
conference with the parties as well as a confirming telephone
call, prior to any hearing.  This proposed change would have
saved the Industrial Commission in excess of $3,000.00 in 2005. 


                          FISCAL NOTE
                                
This amendment may reduce operating costs for the Industrial
Commission.  However, it will have no affect on the general fund
as the Industrial Commission is a dedicated fund agency.
