]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1143 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO REGIONAL MENTAL HEALTH SERVICES; AMENDING SECTION 39-3134A, IDAHO 3 CODE, TO REVISE PROVISIONS APPLICABLE TO DEVELOPMENT GRANTS. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 39-3134A, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 39-3134A. COOPERATIVE SERVICE PLAN COMPONENT. (1) The regional mental 8 health board may undertake development of a service plan component specifi- 9 cally designed to address an identified unmet need in the region. Such a ser- 10 vice plan component may be based upon the assertive community treatment team 11 model, other available intensive models, or a model unique to the region. Such 12 a service plan component shall specify the distinct resource contribution of 13 each participating entity, the terms and conditions of participation and the 14 measures to be used to assess performance and outcomes under the service plan 15 component. The service plan component shall include governance procedures, 16 evaluation data, and the means for amendment or termination of the service 17 plan component. 18 (2) If a service plan component is developed pursuant to this section and 19 approved by the state mental health authority, the service plan component 20 shall be funded by the state as provided in the service plan component, sub- 21 ject to the appropriation made for that purpose. 22 (3) In addition to the funds provided for in section 39-3136, Idaho Code, 23 the state may provide development grants for mental health and substance abuse 24 treatment services through the state mental health authority,andworking in 25 coordination as a development grant advisory group with the department of cor- 26 rection, the department of juvenile corrections, the courts and the regional 27 mental health board.forSuch treatment services shall include, but not be 28 limited to: twenty-four (24) hour emergency psychiatric services, short-term 29 psychiatric beds, crisis intervention teams, transitional housing and detoxi- 30 fication facilities. The development grants may be made on a multiagency, 31 multiyear basis. Proposals for development grants shall be submitted no later 32 than August 1 and shall be granted no later than October 1 on such forms and 33 in such a manner as provided by rule by the state mental health authority. 34 (4) Nothing in this chapter shall preclude the regional mental health 35 board from receiving private and other public funding to assist the regional 36 mental health board in providing services.
STATEMENT OF PURPOSE RS 16938 This legislation is a recommendation of the Interim Committee on Mental Health and Substance Abuse that met during the past summer and fall of 2006. This legislation modifies and expands the state mental health authority development grant program to include substance abuse services. Additionally, the legislation authorizes grant awards to include multi disciplinary proposals that encompass the departments of corrections, juvenile corrections, and the courts as well as the regional mental health boards. Also, depending on funding availability, development grants could be awarded on an on-going multi year basis. FISCAL NOTE Any fiscal impact is dependent on a legislative appropriation in any given year. This year, there is a request from the Interim Committee on Substance Abuse and Mental Health to the Joint Appropriation and Finance Committee to fund the mental health development grant program with $2,000,000 of one-time appropriations and another $1,400,000 of on-going appropriations.
