1 AN ACT
2 APPROPRIATING MONEYS TO THE DIVISION OF BUILDING SAFETY FOR FISCAL YEAR 2008;
3 LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; REAPPROPRIATING
4 CERTAIN UNEXPENDED AND UNENCUMBERED FUND BALANCES; DIRECTING THE DISTRIBU-
5 TION OF THE FUNDING FOR EMPLOYEE COMPENSATION; AND DIRECTING ALLOCATION OF
6 SALARY SAVINGS.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. There is hereby appropriated to the Division of Building
9 Safety in the Department of Self-Governing Agencies the following amounts to
10 be expended according to the designated expense classes from the listed funds
11 for the period July 1, 2007, through June 30, 2008:

33 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Division
34 of Building Safety in the Department of Self-Governing Agencies is authorized
35 no more than one hundred fifty-two (152) full-time equivalent positions at any
36 point during the period July 1, 2007, through June 30, 2008, for the programs
37 specified in Section 1 of this act, unless specifically authorized by the Gov-
38 ernor. The Joint Finance-Appropriations Committee will be notified promptly of
39 any increased positions so authorized.
40 SECTION 3. There is hereby reappropriated to the Division of Building
41 Safety the unexpended and unencumbered balance of operating expenditures
42 appropriated for the period July 1, 2006, through June 30, 2007, for licensing

1 software to be used for nonrecurring expenditures for the purchase of licens-
2 ing software for the period July 1, 2007, through June 30, 2008.
3 SECTION 4. Agencies and institutions shall distribute the funding for
4 employee compensation based on merit as follows:
5 (a) Agencies and institutions are directed to, based on merit, target
6 funding first toward high turnover classifications and individuals below
7 midpoint within their agency.
8 (b) Agencies and institutions are directed to, based on merit, target
9 funding second toward positions within their agency that are below ninety
10 percent (90%) of the Compa-Ratio.
11 (c) Agencies and institutions are directed to target any remaining fund-
12 ing based on merit using the merit matrix required by Idaho Code.
13 Agencies and institutions shall create compensation and distribution plans to
14 ensure that they are consistent with the policies contained herein. Agency
15 directors and institutional presidents shall approve all compensation and dis-
16 tribution plans and ensure that implementation of the plans is consistent with
17 policies contained herein. Each agency and institution shall forward, for
18 informational purposes, approved copies of the compensation and distribution
19 plans to the Legislative Services Office and the Division of Financial Manage-
20 ment by June 1, 2007. The effective date of implementation of ongoing salary
21 adjustments shall be June 17, 2007.
22 SECTION 5. The Division of Building Safety is hereby directed to allocate
23 salary savings, based on performance, to provide for employee salary needs
24 before other operational budget priorities are considered. Where applicable,
25 employees whose salaries are below the midpoint of their pay grade or occupa-
26 tional groups with significant turnover rates shall be considered first in the
27 order of salary savings distributions.
