1 AN ACT
2 APPROPRIATING MONEYS FOR THE IDAHO EDUCATIONAL PUBLIC BROADCASTING SYSTEM FOR
3 FISCAL YEAR 2008; LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS;
4 DIRECTING THE ENCUMBRANCE OF CERTAIN MONEYS AND PROVIDING LEGISLATIVE
5 INTENT; DIRECTING THE DISTRIBUTION OF THE FUNDING FOR EMPLOYEE COMPENSA-
6 TION; AND DIRECTING THE ALLOCATION OF SALARY SAVINGS.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. There is hereby appropriated to the State Board of Education
9 for the Idaho Educational Public Broadcasting System the following amounts to
10 be expended according to the designated expense classes from the listed funds
11 for the period July 1, 2007, through June 30, 2008:

20 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Idaho Edu-
21 cational Public Broadcasting System is authorized no more than thirty-three
22 (33) full-time equivalent positions to be funded by the appropriation in Sec-
23 tion 1 of this act, at any point during the period July 1, 2007, through June
24 30, 2008, unless specifically authorized by the Governor. The Joint Finance-
25 Appropriations Committee will be notified promptly of any increased positions
26 so authorized.
27 SECTION 3. Any unspent moneys appropriated for digital equipment upgrades
28 for the period July 1, 2006, through June 30, 2007, shall be encumbered for
29 the purposes of completing the digital equipment upgrade projects for which
30 the moneys were appropriated for the period July 1, 2007, through June 30,
31 2008. This appropriation acknowledges that additional non-state grant funds
32 may become available to support digital equipment upgrades during the period
33 July 1, 2007, through June 30, 2008. It is legislative intent that Idaho Pub-
34 lic Television seek such funds to replace General Fund moneys appropriated for
35 digital equipment upgrades by this act, and that any General Fund moneys so
36 replaced shall be utilized for replacement items requested, but not funded,
37 during the period July 1, 2007, through June 30, 2008.
38 SECTION 4. Agencies and institutions shall distribute the funding for
39 employee compensation based on merit as follows:
40 (a) Agencies and institutions are directed to, based on merit, target
41 funding first toward high turnover classifications and individuals below

1 midpoint within their agency.
2 (b) Agencies and institutions are directed to, based on merit, target
3 funding second toward positions within their agency that are below ninety
4 percent (90%) of the Compa-Ratio.
5 (c) Agencies and institutions are directed to target any remaining fund-
6 ing based on merit using the merit matrix required by Idaho Code.
7 Agencies and institutions shall create compensation and distribution plans to
8 ensure that they are consistent with the policies contained herein. Agency
9 directors and institutional presidents shall approve all compensation and dis-
10 tribution plans and ensure that implementation of the plans is consistent with
11 policies contained herein. Each agency and institution shall forward, for
12 informational purposes, approved copies of the compensation and distribution
13 plans to the Legislative Services Office and the Division of Financial Manage-
14 ment by June 1, 2007. The effective date of implementation of ongoing salary
15 adjustments shall be June 17, 2007.
16 SECTION 5. The Idaho Educational Public Broadcasting System is hereby
17 directed to allocate salary savings, based on performance, to provide for
18 employee salary needs before other operational budget priorities are consid-
19 ered. Where applicable, employees whose salaries are below the midpoint of
20 their pay grade or occupational groups with significant turnover rates shall
21 be considered first in the order of salary savings distributions.

This is the Fiscal Year 2008 appropriation for Idaho Public Television, in the amount of $4,229,100. In addition to the appropriation, Section 3 of the bill encumbers any unspent digital equipment upgrade money from Fiscal Year 2007 for the purposes of completing those projects in Fiscal Year 2008. Section 3 also requests the agency to seek non-state funding sources for digital equipment upgrades in Fiscal Year 2008, and allows the agency to use any General Fund offset savings so generated for other requested replacement items not funded by this budget.
