2 APPROPRIATING MONEYS TO THE DEPARTMENT OF COMMERCE FOR FISCAL YEAR 2008; LIM-
3 ITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; DIRECTING THE DISTRI-
4 BUTION OF THE FUNDING FOR EMPLOYEE COMPENSATION; DIRECTING ALLOCATION OF
5 SALARY SAVINGS; DIRECTING THE STATE CONTROLLER TO TRANSFER MONEYS TO THE
6 BUSINESS AND JOBS DEVELOPMENT FUND; AND DIRECTING THE STATE CONTROLLER TO
7 TRANSFER MONEYS TO THE FILM AND TELEVISION PRODUCTION REBATE FUND.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. There is hereby appropriated to the Department of Commerce the
10 following amounts from the listed funds to be expended according to the desig-
11 nated expense classes for the period July 1, 2007, through June 30, 2008:

42 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Department

1 of Commerce is authorized no more than fifty-seven (57) full-time equivalent
2 positions at any point during the period July 1, 2007, through June 30, 2008,
3 for the program specified in Section 1 of this act, unless specifically autho-
4 rized by the Governor. The Joint Finance-Appropriations Committee will be
5 notified promptly of any increased positions so authorized.
6 SECTION 3. Agencies and institutions shall distribute the funding for
7 employee compensation based on merit as follows:
8 (a) Agencies and institutions are directed to, based on merit, target
9 funding first toward high turnover classifications and individuals below
10 midpoint within their agency.
11 (b) Agencies and institutions are directed to, based on merit, target
12 funding second toward positions within their agency that are below ninety
13 percent (90%) of the Compa-Ratio.
14 (c) Agencies and institutions are directed to target any remaining fund-
15 ing based on merit using the merit matrix required by Idaho Code.
16 Agencies and institutions shall create compensation and distribution plans to
17 ensure that they are consistent with the policies contained herein. Agency
18 directors and institutional presidents shall approve all compensation and dis-
19 tribution plans and ensure that implementation of the plans is consistent with
20 policies contained herein. Each agency and institution shall forward, for
21 informational purposes, approved copies of the compensation and distribution
22 plans to the Legislative Services Office and the Division of Financial Manage-
23 ment by June 1, 2007. The effective date of implementation of ongoing salary
24 adjustments shall be June 17, 2007.
25 SECTION 4. The Department of Commerce is hereby directed to allocate sal-
26 ary savings, based on performance, to provide for employee salary needs before
27 other operational budget priorities are considered. Where applicable, employ-
28 ees whose salaries are below the midpoint of their pay grade or occupational
29 groups with significant turnover rates shall be considered first in the order
30 of salary savings distributions.
31 SECTION 5. On July 1, 2007, or as soon thereafter as possible, the State
32 Controller shall transfer the sum of $1,000,000 from the Incumbent Worker
33 Training Revolving Loan Fund to the Business and Jobs Development Fund. The
34 maximum grant amount shall be $250,000 per recipient.
35 SECTION 6. On July 1, 2007, or as soon thereafter as possible, the State
36 Controller shall transfer the sum of $1,000,000 from the Incumbent Worker
37 Training Revolving Loan Fund to the Film and Television Production Rebate
38 Fund.

This is the Fiscal Year 2008 appropriation for the Department of Commerce in the amount of $32,771,000. The Department of Commerce is funded with a mix of General Funds, dedicated funds, and federal grants. The Legislature approved, in House Bill 222, splitting apart the Department of Commerce and Labor into two separate departments. This appropriation bill provides funding for the new stand alone Department of Commerce.
