2 APPROPRIATING MONEYS TO THE DIVISION OF HUMAN RESOURCES FOR FISCAL YEAR 2008;
3 LIMITING THE NUMBER OF AUTHORIZED FULL-TIME EQUIVALENT POSITIONS; DIRECT-
4 ING THE COLLECTION OF FEES BY THE DIVISION OF HUMAN RESOURCES AND DIRECT-
5 ING THE EXPENDITURE OF FUNDS FOR PERSONNEL COSTS; LIMITING THE BUDGET FOR
6 THE DIVISION OF HUMAN RESOURCES; DIRECTING THE DISTRIBUTION OF THE FUNDING
7 FOR EMPLOYEE COMPENSATION; AND DIRECTING THE ALLOCATION OF SALARY SAVINGS.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. There is hereby appropriated to the Office of the Governor for
10 the Division of Human Resources the following amounts to be expended according
11 to the designated expense classes from the listed funds for the period July 1,
12 2007, through June 30, 2008:

24 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Division
25 of Human Resources is authorized no more than thirty-six (36) full-time equiv-
26 alent positions at any point during the period July 1, 2007, through June 30,
27 2008, for the program specified in Section 1 of this act, unless specifically
28 authorized by the Governor. The Joint Finance-Appropriations Committee will be
29 notified promptly of any increased positions so authorized.
30 SECTION 3. The Division of Human Resources shall collect the full amount
31 of fees that are included in the personnel costs for participating agencies in
32 accordance with the methodology provided in Section 67-5314(2), Idaho Code,
33 for fiscal year 2008. No agency or institution may spend any funds provided
34 for personnel costs from their respective appropriation for purposes other
35 than those provided for in Section 67-5314, Idaho Code. Any funds paid back to
36 agencies or institutions through interagency billings shall be considered
37 state funds and as such are subject to appropriation in accordance with Sec-
38 tion 67-5316(3)(b), Idaho Code.
39 SECTION 4. Notwithstanding the provisions of Section 67-5314, Idaho Code,
40 which provides that all moneys in the Division of Human Resources Fund are
41 hereby perpetually appropriated, such funds must be spent in accordance with

1 the appropriation as provided in Section 1 of this act. Section 1 of this act
2 is the authorized budget of the Division of Human Resources as provided in
3 Section 67-5314, Idaho Code. In addition, the Joint Finance-Appropriations
4 Committee is authorized to appropriate to any agency operating under a contin-
5 uous appropriation in accordance with Section 67-3514, Idaho Code.
6 SECTION 5. Agencies and institutions shall distribute the funding for
7 employee compensation based on merit as follows:
8 (a) Agencies and institutions are directed to, based on merit, target
9 funding first toward high turnover classifications and individuals below
10 midpoint within their agency.
11 (b) Agencies and institutions are directed to, based on merit, target
12 funding second toward positions within their agency that are below ninety
13 percent (90%) of the Compa-Ratio.
14 (c) Agencies and institutions are directed to target any remaining fund-
15 ing based on merit using the merit matrix required by Idaho Code.
16 Agencies and institutions shall create compensation and distribution plans to
17 ensure that they are consistent with the policies contained herein. Agency
18 directors and institutional presidents shall approve all compensation and dis-
19 tribution plans and ensure that implementation of the plans is consistent with
20 policies contained herein. Each agency and institution shall forward, for
21 informational purposes, approved copies of the compensation and distribution
22 plans to the Legislative Services Office and the Division of Financial Manage-
23 ment by June 1, 2007. The effective date of implementation of ongoing salary
24 adjustments shall be June 17, 2007.
25 SECTION 6. The Division of Human Resources is hereby directed to allocate
26 salary savings, based on performance, to provide for employee salary needs
27 before other operational budget priorities are considered. Where applicable,
28 employees whose salaries are below the midpoint of their pay grade or occupa-
29 tional groups with significant turnover rates shall be considered first in the
30 order of salary savings distributions.
