]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 112 BY JUDICIARY AND RULES COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DEPART- 3 MENT OF HEALTH AND WELFARE RELATING TO MEDICAID ENHANCED PLAN BENEFITS. 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Legislature is vested with authority to reject executive 6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 7 that the Legislature finds that the rules are not consistent with legislative 8 intent; and 9 WHEREAS, it is the finding of the Legislature that a certain rule of the 10 Department of Health and Welfare regarding Medicaid Enhanced Plan Benefits is 11 not consistent with legislative intent and should be rejected. 12 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 13 of the Fifty-ninth Idaho Legislature, the Senate and the House of Representa- 14 tives concurring therein, that IDAPA 16.03.10, Medicaid Enhanced Plan Bene- 15 fits, Section 112, relating to Enhanced Outpatient Mental Health Services - 16 Participant Eligibility, Subsections 02.d and 03.a, only, Rules of the Depart- 17 ment of Health and Welfare, as adopted as pending rules under Docket Number 18 16-0310-0602, be, and the same are hereby rejected and declared null, void and 19 of no force and effect.
STATEMENT OF PURPOSE RS 17013 This concurrent resolution would reject two subsections of a pending rule of the Department of Health and Welfare Pertaining to Medicaid Enhanced Plan Benefits. The effect of this resolution, if adopted by both houses, would be to prevent the subsections of the agency rule from going into effect. FISCAL IMPACT This concurrent resolution has no fiscal impact.
