]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 115 BY JUDICIARY AND RULES COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DEPART- 3 MENT OF COMMERCE AND LABOR RELATING TO UNEMPLOYMENT INSURANCE TAX ADMINIS- 4 TRATION RULES. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, the Legislature is vested with authority to reject executive 7 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 8 that the Legislature finds that the rules are not consistent with legislative 9 intent; and 10 WHEREAS, it is the finding of the Legislature that certain rules of the 11 Department of Commerce and Labor pertaining to Unemployment Insurance Tax 12 Administration Rules are not consistent with legislative intent and should be 13 rejected. 14 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 15 of the Fifty-ninth Idaho Legislature, the Senate and the House of Representa- 16 tives concurring therein, that IDAPA 09.01.35, Unemployment Insurance Tax 17 Administration Rules, Section 112, relating to Determining Status of Worker, 18 Subsections 03.b, 03.c, 03.d and 03.e, only, Rules of the Department of Com- 19 merce and Labor, as adopted as pending rules under Docket Number 09-0135-0601, 20 be, and the same are hereby rejected and declared null, void and of no force 21 and effect.
STATEMENT OF PURPOSE RS 17052 This concurrent resolution would reject four subsections of a pending rule of the Department of Commerce and Labor pertaining to Unemployment Insurance Tax Administration Rules. The effect of this resolution, if adopted by both houses, would be to prevent these subsections of the agency rule from going into effect. FISCAL NOTE This concurrent resolution has no fiscal impact.
