GUBERNATORIAL APPOINTMENTS - Amends Rule 42 of the Rules of the Senate to
permit the State Affairs Committee or other designated committee to submit
a report on an appointment by the Governor; and to provide that if the
committee fails to submit a report to the whole Senate for adoption, the
adoption shall be deemed rejected and the Senate's consent shall be deemed
not to have been given to the appointment.

SENATE RESOLUTION NO. 101

1 A SENATE RESOLUTION
2 PROVIDING FOR THE AMENDMENT OF RULE 42 OF THE RULES OF THE SENATE.
3 Be It Resolved by the Senate of the State of Idaho:
4 WHEREAS, the Senate deems it necessary and desirable to amend Rule 42 of
5 the Rules of the Senate.
6 NOW, THEREFORE, BE IT RESOLVED by the members of the Senate, assembled in
7 the First Regular Session of the Fifty-ninth Idaho Legislature, that Rule 42
8 of the Rules of the Senate be amended to read as follows:
9 RULE 42
10 Gubernatorial Appointments.--Any appointment by the Governor of the State
11 of Idaho which requires confirmation by the Senate shall be on the desk of the
12 President of the Senate and announced therefrom while in session, not less
13 than three legislative days before being acted upon by the Senate, excepting
14 therefrom any nomination received after the fifty-seventh day of the session;
15 any appointee so chosen by the Governor may be examined by the State Affairs
16 Committee or other designated committee, which committee shall may submit a
17 report to the whole Senate for adoption.
18 Adoption by the Senate of the committee report, if any, shall be affirma-
19 tive action of the Senate on the confirmation of the appointee unless the com-
20 mittee report contains no recommendation. If the committee does not submit a
21 report to the whole Senate for adoption, the appointment shall be deemed
22 rejected and the Senate's consent shall be deemed not to have been given to
23 the appointment.
24 Any report of the committee recommending confirmation of an appointment
25 need be held for only one day when the recommendation for appointment or
26 report of the appointment has been read across the desk more than three days
27 previously.
STATEMENT OF PURPOSE

The purpose of this legislation is to amend Senate Rule 42 to provide that
when considering gubernatorial appointments, if the committee to which the
appointment is referred does not submit a report to the Senate for adoption,
the appointment shall be deemed rejected and the Senate's consent shall be
deemed to not have been given to the appointment.
