]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 111 BY BUSINESS COMMITTEE 1 AN ACT 2 RELATING TO INSURANCE; AMENDING SECTION 41-1302, IDAHO CODE, TO PROHIBIT DIS- 3 HONEST OR PREDATORY INSURANCE PRACTICES RELATED TO MARKETING OR SALES TO 4 UNITED STATES ARMED FORCES SERVICE MEMBERS AND TO AUTHORIZE THE DIRECTOR 5 OF THE DEPARTMENT OF INSURANCE TO PROMULGATE RULES. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 41-1302, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 41-1302. UNFAIR METHODS OF COMPETITION AND DECEPTIVE ACT PROHIBITED. (1) 10 No person shall engage in this state in any trade practice which is prohibited 11 in this chapter, or defined in this chapter as, or determined pursuant to this 12 chapter to be, an unfair method of competition or an unfair or deceptive act 13 or practice in the business of insurance. 14 (2) No person shall engage in dishonest or predatory insurance practices 15 in marketing or sales of insurance to service members of the United States 16 armed forces. Notwithstanding any other provision of title 41, Idaho Code, the 17 director may promulgate rules to define dishonest, unfair, deceptive or preda- 18 tory military sales practices.
STATEMENT OF PURPOSE RS 16849 This proposal amends existing law to authorize the Director of the Department of Insurance to promulgate rules to protect members of the Armed Forces from unscrupulous insurance sales practices. The amendment will allow Idaho to work collectively with other states and the U.S. Secretary of Defense to develop and adopt protection standards to comply with the federal Military Personnel Financial Services Protection Act (Public Law 109-290).
