]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 159 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO HEALTH CARE; AMENDING TITLE 39, IDAHO CODE, BY THE ADDITION OF A 3 NEW CHAPTER 32, TITLE 39, IDAHO CODE, TO PROVIDE A SHORT TITLE, TO CREATE 4 THE COMMUNITY HEALTH CENTER GRANT FUND, TO DEFINE TERMS, TO PROVIDE FOR 5 SCOPE OF GRANT SUPPORT, TO SET FORTH APPLICATION REQUIREMENTS, TO PROVIDE 6 A GRANT AWARD SCHEDULE, TO PROVIDE GRANT AWARD CRITERIA, TO PROHIBIT 7 FRAUDULENT INFORMATION ON GRANT APPLICATIONS AND TO PROVIDE FOR ADMINIS- 8 TRATIVE APPEALS; AMENDING SECTION 39-5903, IDAHO CODE, TO REVISE A DEFINI- 9 TION; AND AMENDING SECTION 39-5904, IDAHO CODE, TO REVISE TERMINOLOGY AND 10 TO REVISE MEMBERSHIP OF THE HEALTH CARE ACCESS GRANT REVIEW BOARD. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. That Title 39, Idaho Code, be, and the same is hereby amended 13 by the addition thereto of a NEW CHAPTER, to be known and designated as Chap- 14 ter 32, Title 39, Idaho Code, and to read as follows: 15 CHAPTER 32 16 IDAHO COMMUNITY HEALTH CENTER GRANT PROGRAM 17 39-3201. SHORT TITLE. This chapter shall be known and may be cited as the 18 "Idaho Community Health Center Grant Program." 19 39-3202. COMMUNITY HEALTH CENTER GRANT FUND. There is hereby created in 20 the state treasury a fund known as the "Community Health Center Grant Fund." 21 Subject to appropriation by the legislature, moneys in the fund shall be used 22 exclusively for the purpose of grants for community health centers in order to 23 improve access to health care services for Idahoans and to provide for the 24 administration of grants pursuant to this chapter. 25 39-3203. DEFINITIONS. As used in this chapter: 26 (1) "Applicant" means an entity submitting documents required by the com- 27 munity health center grant program for the purpose of requesting a grant from 28 the community health center grant fund. 29 (2) "Application period" means the time period from July 1 to August 30 30 of the state fiscal year for which funding is requested. 31 (3) "Approval" means written notification that the application will be 32 awarded funding through the community health center grant fund. 33 (4) "Board" means the health care access grant review board, as estab- 34 lished in section 39-5904, Idaho Code. 35 (5) "Community health center" or "CHC" means a nonprofit organization or 36 county-based governmental entity that: 37 (a) Provides comprehensive primary and preventive medical services and 38 provides or makes referrals for dental and mental health services; 39 (b) Provides outpatient services to persons who are uninsured or have 40 medicaid coverage without regard to a person's ability to pay, provided 2 1 that a minimum of twenty-five percent (25%) of such persons served by the 2 organization or entity are uninsured; 3 (c) Charges for services using a sliding fee schedule based upon income 4 and family size; and 5 (d) Is governed by a community-based board. 6 (6) "Community health center grant" means a grant awarded pursuant to 7 this chapter. 8 (7) "Community health center grant program" means the program that admin- 9 isters the community health center grant fund. 10 (8) "Department" means the department of health and welfare. 11 (9) "Director" means the director of the department of health and wel- 12 fare. 13 (10) "Grant period" means the time period from July 1 through June 30 14 (state fiscal year) for which funding is granted. 15 39-3204. SCOPE OF GRANT SUPPORT. The board may award grants, in accor- 16 dance with the procedures and criteria in this chapter, to community health 17 centers for the purpose of improving access to health care services. 18 (1) Individual grant awards will be limited to a total of five hundred 19 thousand dollars ($500,000) for direct and indirect costs, per year. 20 (2) No project may be funded for more than a total of one (1) year. 21 (3) In addition to other uses as approved by the board, funds awarded 22 under a grant may be used for the purchase, construction, renovation or 23 improvement of real property or for projects which are solely or predominantly 24 designed for the purchase of equipment, including information technology and 25 electronic health records. 26 39-3205. APPLICATION REQUIRED. (1) A completed community health center 27 grant application must be submitted by the applicant for the purpose of 28 requesting a grant on or before the conclusion of the application period spec- 29 ified for the appropriate grant cycle. 30 (2) Each application shall include: 31 (a) Identification of geographical area to be served; 32 (b) Individual or entity requesting funds; 33 (c) Narrative description of the community health needs and the methods 34 to be used to address such needs and demonstrate the potential of the 35 project to improve patient health outcomes and access to health care ser- 36 vices in the community; 37 (d) Identification of measurable goals, objectives and patient health 38 outcomes to be used to reach the goals, and the resources necessary to 39 complete each activity; 40 (e) Estimation of how long it will take to accomplish the individual 41 activities of the project; 42 (f) Demonstrated community support for the project; 43 (g) Proposed project budget including: 44 (i) A line item budget with a brief description of each expense 45 category, including any anticipated operating expenses, capital and 46 equipment or contract expenses; 47 (ii) Documentation of one (1) or more vendor price quotes for all 48 proposed equipment purchases; 49 (iii) Contact person for verification of fiscal information; and 50 (h) Federal tax identification number. 51 (3) All applications must include the required information. 52 (4) The grant application and any attachments submitted by the applicant 53 shall be the primary source of information for awarding a grant. 3 1 39-3206. GRANT AWARD SCHEDULE. The board shall conduct the grant process 2 in accordance with the following schedule: 3 (1) The director shall develop an application form in conformance with 4 section 39-3205, Idaho Code, and make guidance available no later than July 1 5 which shall initiate the application period. 6 (2) The completed application shall be submitted no later than August 30 7 of the application period. 8 (3) The board shall issue notification to every applicant regarding the 9 disposition of their grant request by October 30 of the grant period. 10 (4) Funds for approved grants shall be disbursed during November of that 11 grant period or over the course of the current grant year as funds become 12 available. 13 39-3207. AWARD CRITERIA. The board shall award grants based on the fol- 14 lowing weighted criteria: 15 (1) Background of applicant organization. The applicant must show ade- 16 quate experience, knowledge, and qualifications to adequately perform the 17 scope of work: weight = 15%; 18 (2) Community support. The applicant must demonstrate community support 19 for the project: weight = 10%; 20 (3) Specificity and clarity of scope of project. The proposal will be 21 evaluated based upon demonstrated need and the extent to which the goals and 22 objectives are specific, measurable, and relevant to the purpose of the pro- 23 posal and the activities planned to accomplish those objectives are germane 24 and can be sustained beyond the grant time frame: weight = 30%; 25 (4) Monitoring and evaluation. The proposal will be evaluated based on 26 the extent to which the monitoring and evaluation system will document program 27 progress, or improved patient health outcomes if applicable, and measure 28 effectiveness: weight = 15%; 29 (5) Budget. The proposal will be evaluated based on the extent to which a 30 detailed itemized budget and justification are consistent with stated objec- 31 tives and planned program activities: weight = 20%; 32 (6) Geographical community health center equity. The board shall consider 33 the geographical distribution of past grant awards and shall endeavor to meet 34 community health centers' needs in an equitable manner statewide: weight = 35 10%. 36 39-3208. FRAUDULENT INFORMATION ON GRANT APPLICATION. Providing false 37 information on any application or document submitted under this chapter is a 38 misdemeanor and grounds for declaring the applicant ineligible. Any and all 39 funds determined to have been acquired on the basis of fraudulent information 40 must be returned to the community health center grant fund. This section shall 41 not limit other remedies which may be available for the filing of false or 42 fraudulent applications. 43 39-3209. ADMINISTRATIVE APPEALS. Applicants aggrieved by the award or 44 failure to award a grant pursuant to this chapter shall be afforded the reme- 45 dies provided in chapter 52, title 67, Idaho Code. 46 SECTION 2. That Section 39-5903, Idaho Code, be, and the same is hereby 47 amended to read as follows: 48 39-5903. DEFINITIONS. As used in this chapter: 49 (1) "Applicant" means an entity submitting documents required by the 50 rural health care access program for the purpose of requesting a grant from 4 1 the rural health care access fund. 2 (2) "Application period" means the time period from January 15 to April 3 15 prior to the state fiscal year for which funding is requested. 4 (3) "Approval" means written notification that the application will be 5 awarded funding through the rural health care access fund. 6 (4) "Board" means theruralhealth care access program review board. 7 (5) "Department" means the department of health and welfare. 8 (6) "Director" means the director of the department of health and wel- 9 fare. 10 (7) "Grant period" means the time immediately following the application 11 period from July 1 through June 30 (state fiscal year) for which funding is 12 granted. 13 (8) "Nurse practitioner" means a health care provider licensed pursuant 14 to chapter 14, title 54, Idaho Code. 15 (9) "Oral health care provider" means a dentist or dental hygienist 16 licensed pursuant to chapter 9, title 54, Idaho Code. 17 (10) "Physician assistant" means a health care provider licensed pursuant 18 to chapter 18, title 54, Idaho Code. 19 (11) "Primary care" means the provision of professional comprehensive 20 health services, including oral health care services, that includes health 21 education and disease prevention, initial assessment of health problems, 22 treatment of acute care and chronic health problems, and the overall manage- 23 ment of an individual's or family's health care services as provided by an 24 Idaho licensed internist, obstetrician, gynecologist, pediatrician, family 25 practitioner, general practitioner, dentist, dental hygienist, nurse practi- 26 tioner or physician assistant. It provides the initial contact for health ser- 27 vices and referral for secondary and tertiary care. 28 (12) "Primary care health professional shortage area" means a geographic 29 area or population group which the U.S. secretary of health and human services 30 has determined is underserved by primary care health professional(s). 31 (13) "Medically underserved area" means a geographic area which the U.S. 32 secretary of health and human services has determined is underserved by pri- 33 mary care health professional(s). 34 (14) "Rural health care access grant" means a grant awarded pursuant to 35 this chapter. 36 (15) "Rural health care access program" means the program that administers 37 the rural health care access fund. 38 SECTION 3. That Section 39-5904, Idaho Code, be, and the same is hereby 39 amended to read as follows: 40 39-5904.RURALHEALTH CARE ACCESS GRANT REVIEW BOARD. (1) The director 41 shall appoint the members of a board to be known as theruralhealth care 42 access grant review board, who shall serve at the pleasure of the director. 43 Board members shall not be compensated, but shall be reimbursed for travel 44 expenses incurred for attendance at board meetings. 45 (2) The board shall meet at least annually, for the purposes described in 46 this chapter. 47 (3) The board shall be composed of the following: a representative from 48 the Idaho academy of family physicians, a representative from the nurse prac- 49 titioner conference group, a rural hospital administrator, a representative 50 from the physician assistant association, the health resources section super- 51 visor from the division of health, a faculty member from one (1) of the Idaho 52 family residency programs, an Idaho medical association representative, an 53 Idaho hospital association representative,andan Idaho primary care associa- 5 1 tion representative, and an Idaho association of counties representative. 2 (4) Appointments to the board shall be for three (3) years. Board members 3 may be reappointed at the end of each three (3) year period. Initial appoint- 4 ments shall be staggered in such a manner that approximately one-third (1/3) 5 are appointed for one (1) year, one-third (1/3) are appointed for two (2) 6 years, and one-third (1/3) are appointed for three (3) years. 7 (5) A majority of the board members constitutes a quorum for the transac- 8 tion of business. A majority vote is required by the quorum in finalizing 9 decisions.
STATEMENT OF PURPOSE RS 16722C2 The purpose of this legislation is to create a Community Health Center Grant Fund with the intent of improving access to health care services to Idahoans through grants to qualified community health centers in their communities.
