  1                                        AN ACT
  2    RELATING TO SINGLE COUNTYWIDE HIGHWAY  DISTRICTS;  AMENDING  SECTION  40-1418,
  3        IDAHO  CODE,  TO  PROVIDE  THAT  A  PETITION  FOR  DISSOLUTION OF A SINGLE
  4        COUNTYWIDE HIGHWAY DISTRICT SHALL BE INITIATED BY  TWO  HUNDRED  FIFTY  OR
  5        MORE  QUALIFIED  ELECTORS RESIDING IN EACH OF THE COUNTY COMMISSIONER SUB-
  6        DISTRICTS.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Section 40-1418, Idaho Code, be, and the same  is  hereby
  9    amended to read as follows:
                                                                        
 10        40-1418.  PROCEEDINGS  FOR DISSOLUTION OF EXISTING SINGLE COUNTYWIDE HIGH-
 11    WAY DISTRICT. All proceedings for the dissolution of single countywide highway
 12    districts shall be initiated by a petition of ten percent  (10%)  two  hundred
 13    fifty  (250)  or more of the qualified electors residing in each of the county
 14    commissioner subdistricts, addressed to the commissioners  of  the  county  in
 15    which  the single countywide highway district is situate, and which shall con-
 16    cisely state the grounds or reasons for the dissolution and contain a  request
 17    for  a  hearing  of the petition. A hearing on the petition shall be conducted
 18    pursuant to sections 40-1803 through 40-1805, Idaho Code. Following the  hear-
 19    ing  on  the  petition, the election and process for dissolution shall be con-
 20    ducted as provided in sections 40-1806 through 40-1821, Idaho Code. The  elec-
 21    tion shall be held at the next general election and in the event a majority of
 22    the  qualified electors at the election vote in favor of dissolution, the com-
 23    mission shall immediately  make  and  enter  an  order  declaring  the  single
 24    countywide highway district dissolved.

                       STATEMENT OF PURPOSE

                             RS 17060

The purpose of this legislation is to amend Idaho Code Section
40-4018 to require a petition with 250 signatures of qualified
electors from each subdistrict to trigger dissolution proceedings
for a single county-wide highway district.
