HOUSE CONCURRENT RESOLUTION NO. 16
BY REVENUE AND TAXATION COMMITTEE
1 A CONCURRENT RESOLUTION
2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE IDAHO
3 FISH AND GAME COMMISSION GOVERNING LICENSING.
4 Be It Resolved by the Legislature of the State of Idaho:
5 WHEREAS, the Legislature is vested with authority to reject executive
6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event
7 that the Legislature finds that the rules are not consistent with legislative
8 intent; and
9 WHEREAS, it is the finding of the Legislature that a certain rule of the
10 Idaho Fish and Game Commission Rules Governing Licensing is not consistent
11 with legislative intent and should be rejected.
12 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
13 of the Fifty-ninth Idaho Legislature, the House of Representatives and the
14 Senate concurring therein, that IDAPA 13.01.04, Rules Governing Licensing,
15 Section 505, relating to Deer and Elk Tag Allocation, Subsection 02.e.i, only,
16 Rules of the Idaho Fish and Game Commission, as adopted as a pending rule
17 under Docket Number 13-0104-0601, be, and the same is hereby rejected and
18 declared null, void and of no force and effect.
STATEMENT OF PURPOSE
RS 17027
This concurrent resolution would reject a subsection of a
pending rule of the Idaho Fish and Game Commission pertaining to
Rules Governing Licensing. The effect of this resolution, if
adopted by both houses, would be to prevent subsection of the
agency rule from going into effect.
FISCAL NOTE
This concurrent resolution has no fiscal impact.
