]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT RESOLUTION NO. 1 BY STATE AFFAIRS COMMITTEE 1 A JOINT RESOLUTION 2 PROPOSING AN AMENDMENT TO SECTION 1, ARTICLE III, OF THE CONSTITUTION OF THE 3 STATE OF IDAHO, RELATING TO INITIATIVES TO CONFIRM THAT AN INITIATIVE IS 4 AN ACT AND SHALL EMBRACE BUT ONE SUBJECT AND MATTERS PROPERLY CONNECTED 5 THEREWITH; STATING THE QUESTION TO BE SUBMITTED TO THE ELECTORATE; DIRECT- 6 ING THE LEGISLATIVE COUNCIL TO PREPARE THE STATEMENTS REQUIRED BY LAW; AND 7 DIRECTING THE SECRETARY OF STATE TO PUBLISH THE AMENDMENT AND ARGUMENTS AS 8 REQUIRED BY LAW. 9 Be It Resolved by the Legislature of the State of Idaho: 10 SECTION 1. That Section 1, Article III, of the Constitution of the State 11 of Idaho be amended to read as follows: 12 SECTION 1. LEGISLATIVE POWER -- ENACTING CLAUSE -- REFERENDUM 13 -- INITIATIVE. The legislative power of the state shall be vested in 14 a senate and house of representatives. The enacting clause of every 15 bill shall be as follows: "Be it enacted by the Legislature of the 16 State of Idaho." 17 The people reserve to themselves the power to approve or reject 18 at the polls any act or measure passed by the legislature. This power 19 is known as the referendum, and legal voters may, under such condi- 20 tions and in such manner as may be provided by acts of the legisla- 21 ture, demand a referendum vote on any act or measure passed by the 22 legislature and cause the same to be submitted to a vote of the peo- 23 ple for their approval or rejection. 24 The people reserve to themselves the power to propose laws, and 25 enact the same at the polls independent of the legislature. This 26 power is known as the initiative, and legal voters may, under such 27 conditions and in such manner as may be provided by acts of the leg- 28 islature, initiate any desired legislation and cause the same to be 29 submitted to the vote of the people at a general election for their 30 approval or rejection. For purposes of Section 16, Article III, an 31 initiative is an act and shall embrace but one subject and matters 32 properly connected therewith. 33 SECTION 2. The question to be submitted to the electors of the State of 34 Idaho at the next general election shall be as follows: 35 "Shall Section 1, Article III, of the Constitution of the State of Idaho 36 be amended to confirm that an initiative proposed by the people is an act sub- 37 ject to the provisions of Section 16, Article III, of the Constitution of the 38 State of Idaho and therefore shall embrace but one subject and matters prop- 39 erly connected therewith?". 40 SECTION 3. The Legislative Council is directed to prepare the statements 41 required by Section 67-453, Idaho Code, and file the same. 2 1 SECTION 4. The Secretary of State is hereby directed to publish this pro- 2 posed constitutional amendment and arguments as required by law.
