]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1036 BY FINANCE COMMITTEE 1 AN ACT 2 APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF ENVIRONMENTAL QUALITY FOR 3 FISCAL YEAR 2007; AND DECLARING AN EMERGENCY. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. In addition to the appropriation made in Section 1, Chapter 6 349, Laws of 2006, there is hereby appropriated to the Department of Environ- 7 mental Quality the following amount, to be expended for the designated program 8 according to the designated expense class from the listed fund for the period 9 July 1, 2006, through June 30, 2007: 10 WASTE MANAGEMENT AND REMEDIATION: 11 FOR: 12 Operating Expenditures $5,544,100 13 FROM: 14 Department of Environmental Quality Fund (Federal) $5,544,100 15 SECTION 2. This supplemental appropriation provides $5,544,100 in federal spending authority to the Department of Environmental Quality for yard remediation in the Coeur d’Alene Basin.
Mining began in the Coeur d’Alene River Basin in the late 1880s; lead smelting started in the area known as the Bunker Hill Mining and Metallurgical Complex in Kellogg in 1917 and continued until 1981. The area produced a significant portion of the nation’s silver, lead, and zinc. It was common for mine owners to store large waste piles on site and to dispose of mine wastes directly into the Coeur d’Alene River. An estimated 62 million tons of mine wastes were dumped directly into the river and its tributaries between 1884 and 1968, when the practice was finally halted. Smelter and mine wastes were redistributed throughout the floodplain as river, wind, and human activities reworked the soils. Furthermore, fine particle residues known as tailings were frequently used as fill for residential and commercial construction projects. In 1986, EPA began removing and replacing contaminated soils in public areas such as parks, playgrounds, and roadsides that tested above 1,000 parts per million lead. The next step was to remove and replace soil in residential yards with high lead content. A Record of Decision (ROD) for residential soils in the populated areas was completed in 1991, and EPA began replacing contaminated soils in home yards of pregnant women and young children (age six and under) at highest risk of lead poisoning. DEQ took over this responsibility in 2002, and that same year, EPA issued a 30-year cleanup plan to address mining contamination in the broader Coeur d’Alene Basin upstream and downstream of Coeur d’Alene Lake.

This appropriation provides $5,544,100 in spending authority from federal superfund moneys to the Department of Environmental Quality for the yard remediation program in the Coeur d’Alene Basin. This grant is in addition to three previous awards totaling $25 million of which about $9 million in spending authority remains in the base. Along with $1 million in federal spending authority moved in from other budgets, this appropriation brings federal spending authority to about $15.5 million as an ongoing part of the base for the foreseeable future. This emergency appropriation is necessary due to more yards being cleaned-up in FY 2007 than anticipated when the original budget was set.
Although Superfund grants require a 10% state match, the match is determined on the basis of all projects done in the basin over a period of 30 years. Currently the state provides this match through an annual transfer of $1.5 million from the Water Pollution Control Fund to the Environmental Remediation Fund. No additional state match is required at this time.
