]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1080 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO IMMUNITY FROM LIABILITY; AMENDING SECTION 5-330, IDAHO CODE, TO 3 PROVIDE IMMUNITY FROM CIVIL LIABILITY TO VOLUNTEERS WHO ADMINISTER FIRST 4 AID AT A COMPETITIVE SPORTING EVENT AND TO DEFINE "COMPETITIVE SPORTING 5 EVENT." 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 5-330, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 5-330. IMMUNITY OF PERSONS GIVING FIRST AID FROM DAMAGE CLAIM. (1) That 10 no action shall lie or be maintained for civil damages in any court of this 11 state against any person or persons, or group of persons, who in good faith, 12 being at a competitive sporting event, or being at, or stopping at the scene 13 of an accident, offers and administers first aid or medical attention to any 14 person or persons injured in such accident or competitive sporting event 15 unless it can be shown that the person or persons offering or administering 16 first aid, is guilty of gross negligence in the care or treatment of said 17 injured person or persons or has treated them in a grossly negligent manner. 18 The immunity described herein shall cease upon delivery of the injured person 19 to either a generally recognized hospital for treatment of ill or injured per- 20 sons, or upon assumption of treatment in the office or facility of any person 21 undertaking to treat said injured person or persons, or upon delivery of said 22 injured person or persons into custody of an ambulance attendant. 23 (2) As used in this section, "competitive sporting event" means sports 24 conducted as part of a program sponsored by a public or private school that 25 provides instruction in kindergarten through grade twelve (12) or at a public 26 or private college or university or at a community college.
STATEMENT OF PURPOSE RS 16793 This legislation limits the liability faced by any volunteer who assists an injured person or persons at a competitive sporting event and promotes this sort of volunteerism.
