]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1116 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO RULES OF THE ROAD; AMENDING SECTION 49-613, IDAHO CODE, TO PRO- 3 HIBIT ACTIONS THAT RESULT IN ANY DEBRIS BEING DEPOSITED UPON A HIGHWAY AND 4 TO REQUIRE VEHICLE LOADS TO BE CONTAINED TO PREVENT CONTENTS OR LOAD FROM 5 DROPPING, SIFTING OR LEAKING ONTO THE HIGHWAY OR TO PREVENT THE POSSIBIL- 6 ITY OF CONTENTS OR LOAD BLOWING, SPILLING OR OTHERWISE ESCAPING FROM A 7 VEHICLE THAT IS BEING OPERATED ON THE HIGHWAY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 49-613, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 49-613. PUTTING GLASS OR OTHERINJURIOUS MATERIALSDEBRIS UPON HIGHWAY 12 PROHIBITED -- CONTAINED LOADS. (1) No person shall throw or deposit upon any 13 highway any glass bottle, glass, nails, tacks, wire, cans, or any othersub-14stance likely to injure any person, animal or vehicledebris upon the highway. 15 (2) Any person who drops, or permits to be dropped or thrown, upon any 16 highway anydestructive or injuriousmaterial shall immediately remove that 17 material or cause it to be removed. 18 (3) No vehicle shall be driven or moved on any street or highway unless 19 the vehicle is so constructed, covered or loaded as to prevent: 20 (a) Any of its contents or load from dropping, sifting or leaking onto 21 the highway; or 22 (b) The possibility of any of its contents or load from blowing, spilling 23 or otherwise escaping from the vehicle. 24 (4) Any person removing a wrecked or damaged vehicle from a highway shall 25 remove any glass or otherinjurious substancedebris dropped upon the highway 26 from that vehicle.
Statement of Purpose RS 16848 This legislation amends section 49-613 of Idaho code, to prohibit depositing debris upon the highway and to require vehicles be properly equipped to prevent material from being blown, spilled or allowed to escape while driven on the highway.
