]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1127 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO FISH AND GAME; AMENDING CHAPTER 5, TITLE 36, IDAHO CODE, BY THE 3 ADDITION OF A NEW SECTION 36-506, IDAHO CODE, TO DEFINE TERMS, TO PROVIDE 4 FOR CERTAIN RESTRICTIONS ON THE IMPORTATION AND DISPOSAL OF CERVID CAR- 5 CASSES OR PARTS OF CERVID CARCASSES FROM CHRONIC WASTING DISEASE ENDEMIC 6 AREAS, TO PROVIDE EXCEPTIONS, TO PROVIDE FOR VIOLATIONS AND PENALTIES, TO 7 PROVIDE THAT THE IDAHO DEPARTMENT OF FISH AND GAME SHALL PUBLISH LISTS OF 8 CHRONIC WASTING DISEASE ENDEMIC AREAS AND TO PROVIDE FOR CERTAIN RULEMAK- 9 ING. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Chapter 5, Title 36, Idaho Code, be, and the same is 12 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 13 ignated as Section 36-506, Idaho Code, and to read as follows: 14 36-506. RESTRICTION OF IMPORTATION OF CERVID CARCASSES FROM CWD ENDEMIC 15 AREAS. (1) When used in this section: 16 (a) "CWD" means chronic wasting disease; 17 (b) "CWD endemic area" means any county within the United States, or 18 county, district, division or regional municipality within a Canadian 19 province, with one (1) or more documented case of CWD in either wild or 20 domestic cervidae. 21 (2) No cervid carcass or parts of a cervid carcass shall be imported into 22 the state of Idaho from a CWD endemic area, except for the following body 23 parts: 24 (a) Boned-out meat and commercially processed cuts of meat; 25 (b) Portions of meat with no part of the spinal column or head attached; 26 (c) Hides with no heads attached; 27 (d) Clean skull plates, with no meat or tissue attached, with antlers 28 attached; 29 (e) Antlers with no meat or tissue attached; 30 (f) Finished taxidermy heads; and 31 (g) Upper canine teeth (buglers, whistlers, ivories). 32 Any person violating the provisions of this subsection shall be found guilty 33 as provided in section 36-1401, Idaho Code, and shall be punished as set forth 34 in section 36-1402, Idaho Code. 35 (3) The provisions of this section shall not apply to nonresidents 36 traveling through the state of Idaho, provided that no person, including a 37 nonresident, shall dispose of any cervid carcass or parts of a cervid carcass 38 from a CWD endemic area in the state of Idaho. Any person violating the provi- 39 sions of this subsection shall be guilty of an infraction and shall be pun- 40 ished as set forth in section 36-1402, Idaho Code. 41 (4) The Idaho department of fish and game shall publish, on an annual 42 basis, a list of all CWD endemic areas. During the interim between publica- 43 tions, the department shall add by temporary rule additional CWD endemic 2 1 areas.
STATEMENT OF PURPOSE RS 16836 This legislation amends Title 36 of Idaho Code to restrict the importation of carcasses or certain designated parts of carcasses of deer, elk and other cervids from areas where chronic wasting disease is known to occur.
