]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1131 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING SECTION 49-402, 3 IDAHO CODE, TO PROVIDE A CODE REFERENCE; AMENDING CHAPTER 4, TITLE 49, 4 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 49-415D, IDAHO CODE, TO 5 ESTABLISH A SUPPORT OUR TROOPS SPECIAL LICENSE PLATE PROGRAM; AND PROVID- 6 ING AN EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 11 truck, each neighborhood electric vehicle and each other motor vehicle having 12 a maximum gross weight not in excess of eight thousand (8,000) pounds shall 13 be: 14 Vehicles one (1) and two (2) years old ............................ $48.00 15 Vehicles three (3) and four (4) years old ......................... $36.00 16 Vehicles five (5) and six (6) years old ........................... $36.00 17 Vehicles seven (7) and eight (8) years old ........................ $24.00 18 Vehicles over eight (8) years old ................................. $24.00 19 There shall be twelve (12) registration periods, starting in January for 20 holders of validation registration stickers numbered 1, and proceeding consec- 21 utively through December for holders of validation registration stickers num- 22 bered 12, each of which shall start on the first day of a calendar month and 23 end on the last day of the twelfth month from the first day of the beginning 24 month. Registration periods shall expire midnight on the last day of the reg- 25 istration period in the year designated by the validation registration 26 sticker. The numeral digit on the validation registration stickers shall, as 27 does the registration card, fix the registration period under the staggered 28 plate system of Idaho for the purpose of reregistration and notice of expira- 29 tion. 30 A vehicle that has once been registered for any of the above designated 31 periods shall, upon reregistration, be registered for the period bearing the 32 same number, and the registration card shall show and be the exclusive proof 33 of the expiration date of registration and licensing. Vehicles may be ini- 34 tially registered for less than a twelve (12) month period, or for more than a 35 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 36 tional registration tends to fulfill the purpose of the monthly series regis- 37 tration system. 38 (2) For all school buses operated either by a nonprofit, nonpublic school 39 or operated pursuant to a service contract with a school district for trans- 40 porting children to or from school or in connection with school approved 41 activities, the annual fee shall be twenty-four dollars ($24.00). 42 (3) For all motorcycles and all-terrain vehicles operated upon the public 43 highways the annual fee shall be nine dollars ($9.00). For operation of an 2 1 all-terrain vehicle or motorcycle off the public highways, the fee specified 2 in section 67-7122, Idaho Code, shall be paid. Registration exemptions pro- 3 vided in section 49-426(2), (3) and (4), Idaho Code, apply to all-terrain 4 vehicles and motorcycles used for the purposes described in subsections (2), 5 (3) and (4) of section 49-426, Idaho Code. 6 (4) For all motor homes the fee shall be as specified in subsection (1) 7 of this section and shall be in addition to the fees provided for in section 8 49-445, Idaho Code. 9 (5) Registration fees shall not be subject to refund. 10 (6) A financial institution or repossession service contracted to a 11 financial institution repossessing vehicles under the terms of a security 12 agreement shall move the vehicle from the place of repossession to the finan- 13 cial institution's place of business on a repossession plate. The repossession 14 plate shall also be used for demonstrating the vehicle to a prospective pur- 15 chaser for a period not to exceed ninety-six (96) hours. The registration fees 16 for repossession plates shall be as required in subsection (1) of this section 17 for a vehicle one (1) and two (2) years old. All other fees required under 18 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee. 19 The repossession plate shall be issued on an annual basis by the department. 20 (7) In addition to the annual registration fee in this section, there 21 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 22 program fee of fifteen dollars ($15.00) for all special license plate programs 23 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 24 49-409, 49-414, 49-416, 49-418 and 49-418D, Idaho Code. For special plates 25 issued pursuant to sections 49-406 and 49-406A, Idaho Code, there shall be an 26 initial program fee of twenty-five dollars ($25.00) but there shall be no 27 annual renewal fee. For special plates issued pursuant to sections 49-415C, 28 49-415D, 49-416A, 49-416B, 49-416C, 49-416D, 49-416E, 49-417, 49-417A, 29 49-417B, 49-417C, 49-418A, 49-418B, 49-418C, 49-418E, 49-419, 49-419A, 30 49-419B, 49-419C, 49-419D, 49-420, 49-420A, 49-420B, 49-420C, 49-420D, 49-420E 31 and 49-420G, Idaho Code, there shall be an initial program fee of thirty-five 32 dollars ($35.00) and an annual program fee of twenty-five dollars ($25.00). 33 The fees contained in this subsection shall be applicable to all new special 34 plate programs. The initial program fee and the annual program fee shall be 35 deposited in the state highway account and shall be used to fund the cost of 36 administration of special license plate programs, unless otherwise specified 37 by law. 38 SECTION 2. That Chapter 4, Title 49, Idaho Code, be, and the same is 39 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 40 ignated as Section 49-415D, Idaho Code, and to read as follows: 41 49-415D. SUPPORT OUR TROOPS PLATES. (1) On and after January 1, 2008, any 42 person who is the owner of a vehicle registered under the provisions of sec- 43 tion 49-402, Idaho Code, or registered under any other section of law for 44 which the purchase of special plates is allowed, may apply for and, upon 45 department approval, receive support our troops license plates in lieu of reg- 46 ular license plates. The provisions of this section shall not apply to any 47 vehicle with a registered maximum gross weight over twenty-six thousand 48 (26,000) pounds. Availability of support our troops license plates for other 49 vehicles shall be subject to the rules, policies and procedures of the depart- 50 ment. 51 (2) In addition to the regular registration fee required in chapter 4, 52 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol- 53 lars ($35.00) for the initial issuance of plates, and twenty-five dollars 3 1 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the 2 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in 3 the state highway account and shall be used to fund the cost of administration 4 of this special license plate program. Twenty-five dollars ($25.00) of each 5 initial fee and fifteen dollars ($15.00) of each renewal fee shall be trans- 6 ferred by the state treasurer for deposit to the Idaho support our troops, 7 inc.'s principal office located in Boise, Idaho, and shall be used by the 8 Idaho support our troops, inc. as administrator of the funds, to provide sup- 9 port and assistance to the children, dependents and spouses of military ser- 10 vice members and armed forces members of the army, navy, air force, marine 11 corps, national guard, coast guard and air national guard and reserves. 12 (3) Whenever title or interest in a vehicle registered under the provi- 13 sions of this section is transferred or assigned, the owner may transfer the 14 special plates to another vehicle upon payment of the required transfer fees. 15 The owner may only display the plates on another vehicle upon receipt of the 16 new registration from the department. 17 (4) The support our troops license plate shall be of a color and design 18 in accordance with the provisions of section 49-402C, Idaho Code. The design 19 and any slogan on the plate shall be acceptable to the board of directors of 20 the Idaho support our troops, inc. and shall be approved by the Idaho trans- 21 portation department utilizing a numbering system as determined by the depart- 22 ment. Initial costs of the plate program, including costs of plate design, 23 shall be paid by the Idaho support our troops, inc. 24 (5) Sample support our troops license plates may be purchased for a fee 25 of thirty dollars ($30.00), ten dollars ($10.00) of which shall be deposited 26 in the state highway account and twenty dollars ($20.00) of which shall be 27 transferred to the Idaho support our troops, inc.'s principal office located 28 in Boise, Idaho, and shall be used to provide support and assistance to the 29 children, dependents and spouses of military service members and armed forces 30 members of the army, navy, air force, marine corps, national guard, coast 31 guard and air national guard and reserves. 32 SECTION 3. This act shall be in full force and effect on and after Janu- 33 ary 1, 2008.
STATEMENT OF PURPOSE RS 16990 This legislation would create a special, standardized design license plate for a national 501(c)3 non-profit corporation that is also incorporated in Idaho. The corporation is Support Our Troops, Inc., a public charitable organization established exclusively to support the families of the men and women from Idaho who serve in all components of the United States Military. Support Our Troops, Inc. is organized in all fifty states. To date, 45 of the 50 states have created special license plates to provide funding to Support Our Troops, Inc. It is anticipated that by the end of this year such license plates will be established in every state in the Union. FISCAL NOTE The proceeds from these license plates will be added to other revenue sources available to Support Our Troops, Inc. to assist Idaho's military families with their living, educational and health care needs. Support Our Troops will work in conjunction with the Idaho Guard and Reserve Families Support Fund, Inc." in the distribution of funds to families.
