  1                                        AN ACT
  2    RELATING TO FISH AND GAME; AMENDING CHAPTER 5, TITLE 36, IDAHO  CODE,  BY  THE
  3        ADDITION  OF A NEW SECTION 36-506, IDAHO CODE, TO RESTRICT THE IMPORTATION
  4        OF CERVID CARCASSES OR PARTS OF CERVID  CARCASSES  FROM  OTHER  STATES  OR
  5        COUNTRIES,  TO PROVIDE EXCEPTIONS, TO PROVIDE FOR CERTAIN TESTING, TO PRO-
  6        VIDE THAT THE DEPARTMENT OF  FISH  AND  GAME  SHALL  MAKE  TEST  KITS  AND
  7        INSTRUCTIONS AVAILABLE AND TO PROVIDE FOR VIOLATIONS AND PENALTIES.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Chapter  5,  Title  36, Idaho Code, be, and the same is
 10    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 11    ignated as Section 36-506, Idaho Code, and to read as follows:
                                                                        
 12        36-506.  RESTRICTION  OF  IMPORTATION  OF  CERVID CARCASSES. (1) No cervid
 13    carcass or parts of a cervid carcass shall be imported into the state of Idaho
 14    from another state or country, except for the following body parts:
 15        (a)  Meat that is cut and wrapped, either commercially or privately;
 16        (b)  Quarters or other portions of meat to which no  part  of  the  spinal
 17        column or head is attached;
 18        (c)  Meat that has been deboned;
 19        (d)  Hides with no heads attached;
 20        (e)  Finished taxidermy heads;
 21        (f)  Antlers with no meat or tissue attached;
 22        (g)  Skulls with antlers attached and with no meat or tissue attached; and
 23        (h)  Upper canine teeth.
 24        (2)  The  prohibition  in  subsection  (1) shall not apply to carcasses or
 25    parts of carcasses imported into the state of Idaho from any state or  country
 26    contiguous  to the state of Idaho, provided that any person importing a cervid
 27    carcass or part of a cervid carcass, other than those body parts identified in
 28    paragraphs (a) through (h) of subsection (1), into the state from a contiguous
 29    state or country shall:
 30        (a)  At the time the animal is taken, obtain a blood sample  and  preserve
 31        the  same  in  accordance  with instructions provided by the department of
 32        fish and game pursuant to subsection (3) of this section for  the  purpose
 33        of testing for brucellosis;
 34        (b)  Within  twenty-four  (24)  hours  of the animal being taken, obtain a
 35        brain stem tissue sample and preserve the same in formaldehyde  in  accor-
 36        dance  with  the  instructions provided by the department of fish and game
 37        pursuant to subsection (3) of this section for the purpose of testing  for
 38        chronic wasting disease;
 39        (c)  Within fourteen (14) days of the animal being taken, deliver the sam-
 40        ples  to  an office of the department of fish and game along with a fee in
 41        the amount of twenty-five dollars ($25.00) to defray costs of kit prepara-
 42        tion and distribution, sample receipt and testing and information  setting
 43        forth  the specific location the animal was taken, the date the animal was

  1        taken, and the identity of the individual that took the animal.
  2    Each office of the department of fish and game shall, on a weekly basis,  sub-
  3    mit  blood samples and brain stem samples submitted pursuant to the provisions
  4    of this subsection to an appropriate laboratory for the purpose of testing for
  5    brucellosis and chronic wasting disease. The department shall compile and mon-
  6    itor results of such testing.
  7        (3)  Each office of the department of fish and game shall make  test  kits
  8    and  instructions, including the minimum amount of blood and brain stem tissue
  9    samples required to be collected as well as the method of preservation, avail-
 10    able for purposes of compliance with this section.
 11        (4)  Any person violating the provisions of this section  shall  be  found
 12    guilty  as  provided  in section 36-1401, Idaho Code, and shall be punished as
 13    set forth in section 36-1402, Idaho Code.

To aid in the prevention of disease being introduced into Idaho's
Cervidae by infected animal tissue from other states.


                           FISCAL NOTE

There is no fiscal impact to the general fund.
