]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1160 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO JUDGES; AMENDING SECTION 1-805, IDAHO CODE, TO INCREASE THE NUMBER 3 OF DISTRICT JUDGES IN THE FOURTH JUDICIAL DISTRICT BY ONE JUDGE AND TO 4 REVISE THE NUMBER OF RESIDENT CHAMBERS ACCORDINGLY. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 1-805, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 1-805. FOURTH DISTRICT -- NUMBER OF JUDGES -- RESIDENT CHAMBERS. (1) The 9 fourth judicial district shall consist of the counties of Valley, Boise, Ada 10 and Elmore. 11 (2) The fourth judicial district shall havenineten (910) district 12 judges. 13 (3) Resident chambers of the district judges of the fourth judicial dis- 14 trict shall be established as follows: 15 (a)EightNine (89) resident chambers shall be established in Ada County; 16 (b) One (1) resident chambers shall be established in Ada or Elmore 17 County.
STATEMENT OF PURPOSE RS 16995 This bill would add a new district judge position in the Fourth Judicial District with resident chambers in Ada County. No new district judge positions have been added in the Fourth Judicial District since 1998. Since that time, the judiciary has been able to keep pace with the increasing caseload by the use of senior judges and by having active judges assigned to cases in districts other than their own when required. However, there has been a 29 percent increase in population in Ada County since the last district judge position in that county was created in 1998, and a corresponding increase in the demands on the court system. In addition, the Ada County Drug Court and Mental Health Court began operation since the addition of the last district judge position in Ada County. These courts have provided a cost- effective means of furthering rehabilitation, avoiding expensive incarceration, and protecting the community. They have been able to operate only because judges have been willing to devote their time, beyond normal working hours, to preside over these courts. Dealing with the demands of Ada County's burgeoning population, and further expanding the capacity of the Drug and Mental Health Courts, require additional judicial resources. FISCAL NOTE The annual salary and benefits for the district judge position and other costs, including salary and benefits for an additional court reporter, would total approximately $210,300 in general funds.
