]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE BILL NO. 1163 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO RECORDING OF SURVEYS; AMENDING SECTION 55-1906, IDAHO CODE, TO 3 REQUIRE RECORDS OF SURVEY TO SHOW A DESCRIPTION OR GRAPHICAL REPRESENTA- 4 TION OF DISCREPANCIES BETWEEN BOUNDARY LINES, AS DETERMINED IN THE SURVEY, 5 AND FENCE LINES OR OTHER EVIDENCE OF PARTITION. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 55-1906, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 55-1906. RECORDS OF SURVEY -- CONTENTS. The records of survey shall show: 10 (1) All monuments found or set or reset or replaced, or removed, describ- 11 ing their kind, size, location using bearings and distances, and giving other 12 data relating thereto; 13 (2) Evidence of compliance with chapter 16, title 55, Idaho Code, includ- 14 ing instrument numbers of any corner records which have been recorded previ- 15 ously and corner records of any corners which are set in conjunction with the 16 survey being submitted; basis of bearings, bearing and length of lines, scale 17 of map, and north arrow; 18 (3) Section, or part of section, township and range in which the survey 19 is located and reference to surveys of record within or crossing or adjoining 20 the survey; 21 (4) Certificate of survey; 22 (5) Ties to at least two (2) public land survey corner monuments of 23 record in one (1) or more of the sections containing the record of survey, or 24 in lieu of public land survey corners, to two (2) corners of records recog- 25 nized by the county surveyor. Records of survey which are within previously 26 platted subdivisions of record need not be tied to public land survey corner 27 monuments; and 28 (6) A description or graphical representation, or both, of discrepancies 29 between boundary lines, as determined in the survey, and fence lines or other 30 evidence of partition.
STATEMENT OF PURPOSE RS 16983C1 The bill will add a requirement that a record of survey will show a description or graphical representation, or both, of discrepancies between boundary lines, as determined in the survey, and fence lines or other evidence of partition of property. This requirement will help those who are considering the purchase of property by informing them of conditions that may lead to an adverse possession of a portion of the property under consideration.
