1 AN ACT
2 APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF AGRICULTURE FOR FISCAL
3 YEAR 2007; AND DECLARING AN EMERGENCY.
4 Be It Enacted by the Legislature of the State of Idaho:
5 SECTION 1. In addition to the appropriation made in Section 1, Chapter
6 343, Laws of 2006, there is hereby appropriated to the Department of Agricul-
7 ture the following amount, to be expended for the designated program according
8 to the designated expense classes from the listed fund for the period July 1,
9 2006, through June 30, 2007:

17 SECTION 2. An emergency existing therefor, which emergency is hereby
18 declared to exist, this act shall be in full force and effect on and after its
19 passage and approval.

This is a fiscal year 2007 supplemental appropriation to the Department of Agriculture in the amount of $200,000 in dedicated funds. The Idaho Food Quality Assurance Institute, in Twin Falls, has received additional revenues for services from the United States Department of Agriculture (USDA) for test analysis for soil samples to detect Potato Cyst Nematode (PCN). The revenues are collected through a contract for services with the USDA based upon the number of tests performed by the lab and the expenses are charged to the dedicated fund for operational costs. The hiring of additional temporary staff and additional operating costs have resulted in an increase of expenses above and beyond their normal budgeted operations. Although the lab received $75,000 in additional authority for the FY 2007 budget year, the increase in services resulted in an expected shortage of spending authority for the remainder of FY 2007. This supplemental appropriation for the Lab provides $200,000 additional spending authority to continue operations through the end of the current fiscal year.
