  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR THE STATE LIQUOR DISPENSARY  FOR  FISCAL  YEAR  2008;
  3        LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; TRANSFERRING MONEYS
  4        FROM THE LIQUOR CONTROL FUND TO THE LIQUOR WAREHOUSE REMODEL FUND; DIRECT-
  5        ING  THE  DISTRIBUTION OF THE FUNDING FOR EMPLOYEE COMPENSATION; DIRECTING
  6        THE ALLOCATION OF SALARY SAVINGS; AND DECLARING AN EMERGENCY FOR SECTION 3
  7        OF THIS ACT.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  There is hereby appropriated to the Office of the Governor for
 10    the State Liquor Dispensary the following amounts to be expended according  to
 11    the  designated  expense  classes  from the listed fund for the period July 1,
 12    2007, through June 30, 2008:

 24        SECTION 2.  In accordance with Section  67-3519,  Idaho  Code,  the  State
 25    Liquor  Dispensary  is  authorized no more than one hundred ninety-three (193)
 26    full-time equivalent positions at any point during the period  July  1,  2007,
 27    through  June  30,  2008,  for the program specified in Section 1 of this act,
 28    unless  specifically  authorized  by  the   Governor.   The   Joint   Finance-
 29    Appropriations  Committee will be notified promptly of any increased positions
 30    so authorized.
                                                                        
 31        SECTION 3.  On or before June 30,  2007,  the  State  Controller,  at  the
 32    request  of  the  director  of  the  State  Liquor  Dispensary, shall transfer
 33    $2,000,000 from the Liquor Control Fund to the Liquor Warehouse Remodel Fund.
                                                                        
 34        SECTION 4.  Agencies and institutions shall  distribute  the  funding  for
 35    employee compensation based on merit as follows:
 36        (a)  Agencies  and  institutions  are  directed to, based on merit, target
 37        funding first toward high turnover classifications and  individuals  below
 38        midpoint within their agency.
 39        (b)  Agencies  and  institutions  are  directed to, based on merit, target
 40        funding second toward positions within their agency that are below  ninety
 41        percent (90%) of the Compa-Ratio.

  1        (c)  Agencies  and institutions are directed to target any remaining fund-
  2        ing based on merit using the merit matrix required by Idaho Code.
  3    Agencies and institutions shall create compensation and distribution plans  to
  4    ensure  that  they  are  consistent with the policies contained herein. Agency
  5    directors and institutional presidents shall approve all compensation and dis-
  6    tribution plans and ensure that implementation of the plans is consistent with
  7    policies contained herein. Each agency  and  institution  shall  forward,  for
  8    informational  purposes,  approved copies of the compensation and distribution
  9    plans to the Legislative Services Office and the Division of Financial Manage-
 10    ment by June 1, 2007. The effective date of implementation of  ongoing  salary
 11    adjustments shall be June 17, 2007.
                                                                        
 12        SECTION  5.  The  State  Liquor  Dispensary is hereby directed to allocate
 13    salary savings, based on performance, to provide  for  employee  salary  needs
 14    before  other  operational budget priorities are considered. Where applicable,
 15    employees whose salaries are below the midpoint of their pay grade or  occupa-
 16    tional groups with significant turnover rates shall be considered first in the
 17    order of salary savings distributions.
                                                                        
 18        SECTION  6.  An  emergency  existing  therefor,  which emergency is hereby
 19    declared to exist, Section 3 of this act shall be in full force and effect  on
 20    and after passage and approval.
