  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE DEPARTMENT OF  ENVIRONMENTAL  QUALITY  FOR  FISCAL
  3        YEAR  2008; LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; PROVID-
  4        ING THAT THE STATE CONTROLLER SHALL MAKE TRANSFERS  TO  THE  ENVIRONMENTAL
  5        REMEDIATION  FUND; EXPRESSING LEGISLATIVE INTENT REGARDING THE ENVIRONMEN-
  6        TAL REMEDIATION FUND AND REQUIRING AN ANNUAL REPORT;  EXPRESSING  LEGISLA-
  7        TIVE  INTENT  WITH  REGARD  TO  USE  OF  THE WATER POLLUTION CONTROL FUND;
  8        DIRECTING THE DISTRIBUTION  OF  THE  FUNDING  FOR  EMPLOYEE  COMPENSATION;
  9        DIRECTING  THE  ALLOCATION OF SALARY SAVINGS; AND DIRECTING THE STATE CON-
 10        TROLLER TO TRANSFER MONEYS TO THE IDAHO COMMUNITY REINVESTMENT PILOT  INI-
 11        TIATIVE FUND.
                                                                        
 12    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 13        SECTION  1.  There is hereby appropriated to the Department of Environmen-
 14    tal Quality the following amounts to be expended for the  designated  programs
 15    according  to  the  designated  expense  classes from the listed funds for the
 16    period July 1, 2007, through June 30, 2008:

 47        SECTION 2.  In accordance with Section 67-3519, Idaho Code, the Department
 48    of Environmental Quality is authorized no more  than  three  hundred  seventy-
 49    eight and fifty-five hundredths (378.55) full-time equivalent positions at any
 50    point  during  the period July 1, 2007, through June 30, 2008, unless specifi-
 51    cally authorized by the Governor. The Joint  Finance-Appropriations  Committee
 52    will be notified promptly of any increased positions so authorized.

  1        SECTION 3.  Notwithstanding the provisions of Section 39-3630, Idaho Code,
  2    the  State Controller is hereby directed to transfer $1,500,000 from the Water
  3    Pollution Control Fund to the Environmental Remediation Fund (Basin)  for  the
  4    period July 1, 2007, through June 30, 2008.
                                                                        
  5        SECTION  4.  It is legislative intent that moneys deposited into the Envi-
  6    ronmental Remediation Fund (Basin) are to be used for remediation of the Coeur
  7    d'Alene Basin in accordance with the superfund contract with the Environmental
  8    Protection Agency. The Department  of  Environmental  Quality  shall  file  an
  9    annual  report  each  year  with  the Governor, the Legislature, and the Coeur
 10    d'Alene Basin Environmental Improvement Project Commission on the  remediation
 11    progress and the expenditures involved.
                                                                        
 12        SECTION 5.  It is legislative intent that the appropriation of moneys from
 13    the  Water Pollution Control Fund in this act specifically supersedes the pro-
 14    visions of Section 39-3630, Idaho Code.
                                                                        
 15        SECTION 6.  SALARY DISTRIBUTION. Agencies and institutions shall  distrib-
 16    ute the funding for employee compensation based on merit as follows:
 17        (a)  Agencies  and  institutions  are  directed to, based on merit, target
 18        funding first toward high turnover classifications and  individuals  below
 19        midpoint within their agency.
 20        (b)  Agencies  and  institutions  are  directed to, based on merit, target
 21        funding second toward positions within their agency that are below  ninety
 22        percent (90%) of the Compa-Ratio.
 23        (c)  Agencies  and institutions are directed to target any remaining fund-
 24        ing based on merit using the merit matrix required by Idaho Code.
 25    Agencies and institutions shall create compensation and distribution plans  to
 26    ensure  that  they  are  consistent with the policies contained herein. Agency
 27    directors and institutional presidents shall approve all compensation and dis-
 28    tribution plans and ensure that implementation of the plans is consistent with
 29    policies contained herein. Each agency  and  institution  shall  forward,  for
 30    informational  purposes,  approved copies of the compensation and distribution
 31    plans to the Legislative Services Office and the Division of Financial Manage-
 32    ment by June 1, 2007. The effective date of implementation of  ongoing  salary
 33    adjustments shall be June 17, 2007.
                                                                        
 34        SECTION  7.  SALARY  SAVINGS.  The  Department of Environmental Quality is
 35    hereby directed to allocate salary savings, based on performance,  to  provide
 36    for  employee salary needs before other operational budget priorities are con-
 37    sidered.  Where applicable, employees whose salaries are below the midpoint of
 38    their pay grade or occupational groups with significant turnover  rates  shall
 39    be considered first in the order of salary savings distributions.
                                                                        
 40        SECTION  8.  On July 2, 2007, or as soon thereafter as possible, the State
 41    Controller shall transfer $1,500,000 from the General Fund to the Idaho Commu-
 42    nity Reinvestment Pilot Initiative Fund established in Section 39-7211,  Idaho
 43    Code.

This is the fiscal year 2008 appropriation to the Department of Environmental Quality in the amount of $60,850,400 of which $17,402,600 is from the General Fund, $7,266,600 is from dedicated funds, and $36,181,200 is from federal funds. The bill puts a cap of 378.55 full-time equivalent positions (FTP) on the department. The bill transfers $1.5 million from the Water Pollution Control Fund to the Environmental Remediation Fund to be used for the Coeur d’Alene Basin cleanup and it transfers $1.5 million from the General Fund to the Idaho Community Reinvestment Pilot Initiative Fund to be used to reimburse businesses that voluntarily clean up their properties.
