1 AN ACT
2 APPROPRIATING MONEYS TO THE SECRETARY OF STATE FOR FISCAL YEAR 2008; LIMITING
3 THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; DIRECTING THE DISTRIBUTION
4 OF THE FUNDING FOR EMPLOYEE COMPENSATION; AND DIRECTING THE ALLOCATION OF
5 SALARY SAVINGS.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. There is hereby appropriated to the Secretary of State the
8 following amounts to be expended for the designated programs according to the
9 designated expense classes from the listed funds for the period July 1, 2007,
10 through June 30, 2008:

26 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Office of
27 the Secretary of State is authorized no more than thirty-one (31) full-time
28 equivalent positions at any point during the period July 1, 2007, through June
29 30, 2008, for the programs specified in Section 1 of this act, unless specifi-
30 cally authorized by the Governor. The Joint Finance-Appropriations Committee
31 will be notified promptly of any increased positions so authorized.
32 SECTION 3. Agencies and institutions shall distribute the funding for
33 employee compensation based on merit as follows:
34 (a) Agencies and institutions are directed to, based on merit, target
35 funding first toward high turnover classifications and individuals below
36 midpoint within their agency.
37 (b) Agencies and institutions are directed to, based on merit, target
38 funding second toward positions within their agency that are below ninety
39 percent (90%) of the Compa-Ratio.
40 (c) Agencies and institutions are directed to target any remaining fund-
41 ing based on merit using the merit matrix required by Idaho Code.
42 Agencies and institutions shall create compensation and distribution plans to

1 ensure that they are consistent with the policies contained herein. Agency
2 directors and institutional presidents shall approve all compensation and dis-
3 tribution plans and ensure that implementation of the plans is consistent with
4 policies contained herein. Each agency and institution shall forward, for
5 informational purposes, approved copies of the compensation and distribution
6 plans to the Legislative Services Office and the Division of Financial Manage-
7 ment by June 1, 2007. The effective date of implementation of ongoing salary
8 adjustments shall be June 17, 2007.
9 SECTION 4. The Secretary of State is hereby directed to allocate salary
10 savings, based on performance, to provide for employee salary needs before
11 other operational budget priorities are considered. Where applicable, employ-
12 ees whose salaries are below the midpoint of their pay grade or occupational
13 groups with significant turnover rates shall be considered first in the order
14 of salary savings distributions.
