2 APPROPRIATING MONEYS TO THE SUPERINTENDENT OF PUBLIC INSTRUCTION/STATE DEPART-
3 MENT OF EDUCATION FOR FISCAL YEAR 2008; LIMITING THE NUMBER OF FULL-TIME
4 EQUIVALENT POSITIONS; DIRECTING THE DISTRIBUTION OF THE FUNDING FOR
5 EMPLOYEE COMPENSATION; DIRECTING THE ALLOCATION OF SALARY SAVINGS; APPRO-
6 PRIATING ADDITIONAL MONEYS TO THE SUPERINTENDENT OF PUBLIC
7 INSTRUCTION/STATE DEPARTMENT OF EDUCATION FOR FISCAL YEAR 2007; AND
8 DECLARING AN EMERGENCY FOR SECTION 5.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. There is hereby appropriated to the Superintendent of Public
11 Instruction/State Department of Education the following amounts to be expended
12 according to the designated expense classes from the listed funds for the
13 period July 1, 2007, through June 30, 2008:

42 SECTION 2. In accordance with Section 67-3519, Idaho Code, the State
43 Department of Education is authorized no more than one hundred twenty-nine

1 (129) full-time equivalent positions at any point during the period July 1,
2 2007, through June 30, 2008, unless specifically authorized by the Governor.
3 The Joint Finance-Appropriations Committee will be notified promptly of any
4 increased positions so authorized.
5 SECTION 3. Agencies and institutions shall distribute the funding for
6 employee compensation based on merit as follows:
7 (a) Agencies and institutions are directed to, based on merit, target
8 funding first toward high turnover classifications and individuals below
9 midpoint within their agency.
10 (b) Agencies and institutions are directed to, based on merit, target
11 funding second toward positions within their agency that are below ninety
12 percent (90%) of the Compa-Ratio.
13 (c) Agencies and institutions are directed to target any remaining fund-
14 ing based on merit using the merit matrix required by Idaho Code.
15 Agencies and institutions shall create compensation and distribution plans to
16 ensure that they are consistent with the policies contained herein. Agency
17 directors and institutional presidents shall approve all compensation and dis-
18 tribution plans and ensure that implementation of the plans is consistent with
19 policies contained herein. Each agency and institution shall forward, for
20 informational purposes, approved copies of the compensation and distribution
21 plans to the Legislative Services Office and the Division of Financial Manage-
22 ment by June 1, 2007. The effective date of implementation of ongoing salary
23 adjustments shall be June 17, 2007.
24 SECTION 4. The State Department of Education is hereby directed to allo-
25 cate salary savings, based on performance, to provide for employee salary
26 needs before other operational budget priorities are considered. Where appli-
27 cable, employees whose salaries are below the midpoint of their pay grade or
28 occupational groups with significant turnover rates shall be considered first
29 in the order of salary savings distributions.
30 SECTION 5. In addition to the moneys appropriated in Section 1, Chapter
31 427, Laws of 2006, there is hereby appropriated to the Superintendent of Pub-
32 lic Instruction/State Department of Education the following amounts to be
33 expended according to the designated expense classes from the listed funds for
34 the period July 1, 2006, through June 30, 2007:

45 SECTION 6. An emergency existing therefor, which emergency is hereby
46 declared to exist, Section 5 of this act shall be in full force and effect on
