                            SENATE CONCURRENT RESOLUTION NO. 104
                                                                        
                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE  IDAHO
  3        STATE POLICE RULES GOVERNING ALCOHOL BEVERAGE CONTROL.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is the finding of the Legislature that a certain rule of the
 10    Idaho State Police rules governing Alcohol Beverage Control is not  consistent
 11    with legislative intent and should be rejected.
 12        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 13    of  the Fifty-ninth Idaho Legislature, the Senate and the House of Representa-
 14    tives concurring therein, that IDAPA 11.05.01, Rules Governing Alcohol  Bever-
 15    age  Control,  Section 013, relating to Priority Lists, Subsection 04, Limita-
 16    tions on Priority Lists  only, Rules of the Idaho State Police as adopted as a
 17    pending rule under Docket Number 11-0501-0601, be,  and  the  same  is  hereby
 18    rejected and declared null, void and of no force and effect.
