]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature First Regular Session - 2007IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 107 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING THE FINDINGS OF THE LEGISLATURE URGING THE STATE BOARD OF LAND COMMIS- 3 SIONERS TO CONDUCT A STUDY TO DETERMINE WHETHER THE LEASE OF STATE LANDS 4 TO ENCLOSED-PEN HUNTING OPERATIONS IS CONSISTENT WITH ITS LONG-TERM OBLI- 5 GATION TO ENDOWMENT BENEFICIARIES. 6 Be It Resolved by the Legislature of the State of Idaho: 7 WHEREAS, many citizens are concerned with the emergence of enclosed-pen 8 hunting operations, often known as "enclosed-pen shooter bull operations" or 9 "canned hunts" in the state of Idaho; and 10 WHEREAS, the location of enclosed-pen shooter bull operations creates 11 issues regarding access to and from state endowment lands because of the need 12 for substantial fencing and locked gates; and 13 WHEREAS, the impact of enclosed-pen shooter bull operations on native veg- 14 etation on state endowment lands is unknown; and 15 WHEREAS, enclosed-pen shooter bull operations may affect the Department of 16 Lands' ability to manage noxious weeds on state endowment lands because of the 17 high fences and locked gates necessary for such operations; and 18 WHEREAS, the potential state liability for addressing damage caused by 19 enclosed-pen shooter bull operations on state endowment lands is unknown; and 20 WHEREAS, the potential state liability for public health and safety issues 21 arising from enclosed-pen shooter bull operations on state endowment lands is 22 unknown; and 23 WHEREAS, the financial impact on the state endowments from exclusive use 24 of such lands for enclosed-pen shooter bull operations is unknown; and 25 WHEREAS, the impact of enclosed-pen shooter bull operations on future uses 26 of state endowment lands is unknown; and 27 WHEREAS, pursuant to the Constitution of the State of Idaho, the Idaho 28 State Board of Land Commissioners is charged with the direction, control and 29 disposition of the public lands of the state, under such regulations as may be 30 prescribed by law; and in such manner as will secure the maximum long-term 31 financial return for the specific institutions designated by law as the trust 32 beneficiaries; and 33 WHEREAS, the State Board of Land Commissioners may exercise certain dis- 34 cretionary authority in carrying out its trust obligations relating to state 35 lands; and 36 WHEREAS, other opportunities for the lease of state lands may offer, over 37 the long term, greater financial return for trust beneficiaries. 38 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 39 of the Fifty-ninth Idaho Legislature, the Senate and the House of Representa- 40 tives concurring therein, that the State Board of Land Commissioners is urged 41 to conduct a study to determine whether the lease of state lands to enclosed- 42 pen hunting operations is consistent with securing the maximum long-term 43 return to the endowment beneficiaries.
