  1                                        AN ACT
  2    RELATING TO VETERANS SERVICES; AMENDING SECTION 63-3067B, IDAHO CODE, TO  PRO-
  3        VIDE FOR DESIGNATION OF A REFUND DUE AND PAYABLE FOR OVERPAYMENT OF INCOME
  4        TAXES  OR  FOR  A  DONATION IN ADDITION TO AN INCOME TAX OBLIGATION TO THE
  5        VETERANS SUPPORT FUND AND TO  MAKE  TECHNICAL  CORRECTIONS;  AND  AMENDING
  6        CHAPTER  2, TITLE 65, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 65-209,
  7        IDAHO CODE, TO PROVIDE FOR THE CREATION AND OPERATION OF THE VETERANS SUP-
  8        PORT FUND.

  9    Be It Enacted by the Legislature of the State of Idaho:

 10        SECTION 1.  That Section 63-3067B, Idaho Code, be, and the same is  hereby
 11    amended to read as follows:

 12        63-3067B.  DESIGNATION  BY INDIVIDUALS -- TRUST ACCOUNTS. (a1) Every resi-
 13    dent individual who:
 14        (ia)  Has a refund due and payable for overpayment of taxes under this act
 15        may designate all or any portion  thereof  to  be  deposited  in  a  trust
 16        account specified in subsection (c3) below; or
 17        (iib)  Has an income tax liability may, in addition to his tax obligation,
 18        include a donation to be deposited in a trust account specified in subsec-
 19        tion (c3) of this section.
 20        (b2)  A  designation  under subsection (a1) of this section may be made in
 21    any taxable year in such manner and form as prescribed by the state  tax  com-
 22    mission.  The  manner and form so prescribed shall be a conspicuous portion of
 23    the principal form provided for the purpose of individual taxation.
 24        (c3)  The trust accounts authorized to  receive  moneys  designated  under
 25    subsection (a1) of this section are:
 26        (ia)  The  fish  and  game set-aside account created by in section 36-111,
 27        Idaho Code;
 28        (iib)  The Idaho ag in the classroom account created by in section 57-815,
 29        Idaho Code;
 30        (iiic)  The drug  enforcement  donation  account  created  by  in  section
 31        57-816, Idaho Code;
 32        (ivd)  The  children's  trust  fund  created  by in section 39-6007, Idaho
 33        Code;
 34        (ve)  The United States olympic account  created  by  in  section  57-817,
 35        Idaho Code, but no donation shall exceed five dollars ($5.00);
 36        (vif)  The Alzheimer's disease services account created in section 57-819,
 37        Idaho Code;
 38        (viig)  The  community  forestry  trust account created in section 38-136,
 39        Idaho Code; and
 40        (viiih)  The American red cross of greater Idaho fund created  in  section
 41        57-821,  Idaho Code, which donation shall be ten dollars ($10.00) if made;
 42        and
 43        (i)  The veterans support fund created in section 65-209, Idaho Code.

  1        (d4)  Prior to the distribution of funds into any of  the  trust  accounts
  2    specified  in  subsection  (c3)  of  this section from the refund account, the
  3    state tax commission shall retain funds for the commission's  costs  for  col-
  4    lecting  and  administering the moneys in the accounts as follows: three thou-
  5    sand dollars ($3,000) from each account for start-up costs  during  the  first
  6    year  of  collections,  and  three thousand dollars ($3,000) or twenty percent
  7    (20%) of the moneys remitted to each account during the fiscal year, whichever
  8    is less, from each account during each fiscal year thereafter,  which  amounts
  9    are hereby appropriated to the tax commission.

 10        SECTION  2.  That  Chapter  2,  Title  65, Idaho Code, be, and the same is
 11    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 12    ignated as Section 65-209, Idaho Code, and to read as follows:

 13        65-209.  VETERANS  SUPPORT  FUND. (1) There is hereby created in the state
 14    treasury the "Veterans Support Fund" to which shall be credited:
 15        (a)  The moneys designated under section 63-3067B, Idaho Code;
 16        (b)  Gifts, grants, contributions and bequests to the fund;
 17        (c)  Interest earned on the investment of idle moneys in the  fund,  which
 18        shall be paid to the fund; and
 19        (d)  All other moneys as may be provided by law.
 20        (2)  Moneys in the fund shall be used exclusively for the purposes of pro-
 21    grams  to  support veterans, and moneys shall be continuously appropriated for
 22    such purposes.
 23         (3)  Disbursements of moneys from the fund shall be made upon  authoriza-
 24    tion of the administrator of the division of veterans services.

                     STATEMENT OF PURPOSE

With the aging of veterans from the WWII, Korean War, and 
Vietnam War eras, and the needs of Iraq War veterans and their 
families, resources for veterans are becoming over extended.  A 
charitable check-off box on the State Income Tax returns for 
people receiving tax refunds to donate money to be used by the 
Idaho Division of Veterans Services to support programs for 
Idaho veterans will allow Idaho taxpayers to easily donate funds 
to assist veterans.
