  2    RELATING TO LICENSE PLATE  FEES;  AMENDING  SECTION  49-450,  IDAHO  CODE,  TO
  3        INCREASE  ADDITIONAL FEES CHARGED AND DEPOSITED INTO THE PLATE MANUFACTUR-
  4        ING ACCOUNT UPON THE ISSUANCE OF LICENSE PLATES AND TO  MAKE  A  TECHNICAL
  5        CORRECTION.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION  1.  That  Section  49-450, Idaho Code, be, and the same is hereby
  8    amended to read as follows:

  9        49-450.  ADDITIONAL FEE FOR EACH PLATE ISSUED. In addition to the  vehicle
 10    registration  fee  provided  by  law, whenever any plate is issued for vehicle
 11    registration, there shall be charged a fee of three four dollars ($34.00)  per
 12    plate,  which  shall be deposited into the plate manufacturing account created
 13    in section 49-450A, Idaho Code. The actual cost of producing and  distributing
 14    license  plates   and  the fifty cents ($.50¢) per plate fee designated to the
 15    Idaho heritage trust for the use of the copyrighted  design  provided  for  in
 16    section  49-443(1),  Idaho  Code,  shall  be paid from the plate manufacturing
 17    account. The difference between deposits into the  account  and  disbursements
 18    out of the account not required for future obligations shall be transferred by
 19    the  state controller from the plate manufacturing account to the highway dis-
 20    tribution account as established in section 40-701, Idaho Code, for apportion-
 21    ment as designated in that section. Funds designated  to  the  Idaho  heritage
 22    trust  shall  be matched with equal funds from other sources for funding proj-
 23    ects designed to preserve Idaho's historic resources.

  2        On page 1, following line 6, insert:
  3        "SECTION 1.  That Section 49-443, Idaho Code, be, and the same  is  hereby
  4    amended to read as follows:

  5        49-443.  LICENSE  PLATES  TO  BE  FURNISHED BY DEPARTMENT -- FORM AND CON-
  6    TENTS. (1) The assessor or the department shall furnish to every  owner  whose
  7    vehicle is registered by that office, pursuant to sections 49-402 and 49-402A,
  8    Idaho Code, one (1) license plate for vehicles registered under the provisions
  9    of  section  49-406,  49-406A or 49-408, Idaho Code, or a motorcycle, trailer,
 10    truck-tractor, or semitrailer, and two (2)  license  plates  for  every  other
 11    motor  vehicle. If a vehicle is issued one (1) plate only, that plate shall be
 12    displayed in accordance with the provisions of section 49-428, Idaho Code. For
 13    vehicles registered under the provisions of section 49-407,  Idaho  Code,  the
 14    applicant shall provide one (1) plate to be displayed on the rear of the vehi-
 15    cle.
 16        Commencing  January  1,  1992, the color and design of the plates shall be
 17    comparable to the color and  design  of  the  statehood  centennial  issue  of
 18    license  plates  with  blue  black numerals and letters on a multicolored red,
 19    white and blue background. Each license plate must  bear  upon  its  face  the
 20    inscriptions "Famous Potatoes" and "Scenic Idaho."
 21        Every  license  plate shall have displayed upon it the registration number
 22    assigned to the vehicle and its owner and the name "Idaho" which may be abbre-
 23    viated. The plates issued under the provisions  of  section  49-402(1),  Idaho
 24    Code,  and  the  required letters and numerals, including an identification of
 25    the county in which the motor vehicle to which the plates will be  affixed  is
 26    registered, shall be of sufficient size to be plainly readable from a distance
 27    of  seventy-five  (75) feet during daylight, and each license plate and regis-
 28    tration sticker shall be treated with a fully reflectorized material according
 29    to specifications prescribed by the board.
 30        (2)  License plates shall be valid for a period of seven (7) years  begin-
 31    ning  with  the date of issuance of new plates, for all plates issued prior to
 32    July 1, 2008. For all new plates issued on and after  July  1,  2008,  license
 33    plates  shall be valid for a period of ten (10) years. At the end of the sixth
 34    year valid period, the registered owner shall receive notice of the date  upon
 35    which  the  plates  will expire. The department shall implement a plate-number
 36    reservation program beginning prior to the 1999 plate issue and following once
 37    every seven (7) years thereafter, for a limited plate-number sequence in  each
 38    county  which  chooses  to  offer  a reservation program allowing a registered
 39    owner to retain the owner's current issued plate number. Requests for  license
 40    plate  number  reservations  shall be submitted to the county. during the open
 41    reservation period established by the department. The department may charge  a
 42    minimal  fee as determined by the board to recover costs to the department for
 43    reservation of license plate numbers. The provisions of  this  subsection  (2)

  1    shall  not  apply  to  any license plates issued pursuant to the provisions of
  2    section 49-434(4), Idaho Code.
  3        (3)  If a license plate number has expired as provided in  subsection  (2)
  4    of  this  section and the number was not reserved, or if the vehicle registra-
  5    tion is not renewed within sixty (60) days of its expiration, the plate number
  6    shall be available for use by another registrant. To obtain a specific  number
  7    in  the  recycled license plate number file, the owner of a registered vehicle
  8    shall pay a one (1) time fee as determined by rule of the board.
  9        The provisions of this subsection shall apply only to vehicles  registered
 10    under  the provisions of section 49-402(1), Idaho Code, and section 49-434(1),
 11    Idaho Code, as it applies to noncommercial vehicles.
 12        (4)  License plates issued for  vehicles  required  to  be  registered  in
 13    accordance  with  the  provisions  of sections 49-402 and 49-402A, Idaho Code,
 14    shall be issued color coded registration validation stickers showing the  year
 15    of registration. Each registration validation sticker shall bear a number from
 16    1 through 12, which number shall  correspond to the month of the calendar year
 17    in  which  the registration of the vehicle expires and shall be affixed to the
 18    lower right-hand corner of the plates within the outlined rectangular area.
 19        (5)  License plates for utility trailers registered under  the  provisions
 20    of  section  49-402A,  Idaho  Code,  which are issued for five (5) or ten (10)
 21    years and license plates for rental utility trailers registered under the pro-
 22    visions of section 49-434, Idaho Code, which are issued for  up  to  five  (5)
 23    years,  shall use the design in effect on the date of manufacture. If a design
 24    change occurs, plates from the effective date of the design  change  shall  be
 25    manufactured  using  the  new design. Unexpired plates need not be reissued to
 26    conform to a design change.
 27        (6)  For license plates which are lost, stolen, mutilated,  or  illegible,
 28    the  owner  shall apply for a duplicate or substitute. The assessor shall also
 29    furnish for each registration, and to validate the license plate, a  pressure-
 30    sensitive,  uniquely-numbered  registration  sticker,  except for trailers and
 31    semitrailers registered under the nonexpiring provisions  in  section  49-434,
 32    Idaho  Code.  License  plates issued for state, county and city motor vehicles
 33    shall be permanent and remain on the vehicle for which  issued  from  year  to
 34    year, and need no renewal or validation sticker.
 35        (7)  Whenever  a  vehicle  is completely destroyed by fire or accident and
 36    the operator submits satisfactory proof of that destruction to the  department
 37    or  appropriate  assessor's  office,  the  registration use increment and fees
 38    shall be  transferred to the replacement vehicle for a service transfer fee of
 39    five dollars ($5.00), which fee shall be retained by the  registering  author-
 40    ity. None of the original fees shall be subject to  refund.
 41        (8)  The  department  shall furnish to every owner whose vehicle is regis-
 42    tered under sections 49-434 and  49-435,  Idaho  Code,  a  pressure-sensitive,
 43    uniquely-numbered registration sticker to validate the license plate, provided
 44    however, the provisions of this subsection (8) shall not apply to trailers and
 45    semitrailers registered under the provisions of section 49-434(4), Idaho Code.
 46        (9)  The  board  shall have authority to require the return to the depart-
 47    ment of all license plates and registration stickers upon termination  of  the
 48    lawful use of them by the owner.
 49        (10) The board may promulgate such rules as are necessary to implement the
 50    provisions of this section."; and renumber the subsequent section accordingly.

 51                                 CORRECTION TO TITLE
 52        On  page 1, in line 2, following "FEES;" insert: "AMENDING SECTION 49-443,
 53    IDAHO CODE, TO REFERENCE THE CORRECT COLOR OF NUMERALS AND LETTERS ON  LICENSE
 54    PLATES,  TO  PROVIDE  THAT  LICENSE PLATES ISSUED AFTER JULY 1, 2008, SHALL BE

                       STATEMENT OF PURPOSE

This legislation will amend the plate fees currently assessed 
under Idaho Code 49-450 to increase the fee from $3.00 to $4.00.  
Current plate fees do not cover the cost of manufacturing and 
handling of license plates.  Cost increases have been incurred 
over the past several years from Correctional Industries, the 
state's license plate provider, and code has not kept pace with 
these costs.                                  
                                                              
This proposal amends the length of time for replacement of physical 
license plates from 7 to 10 years.  It amends the color from blue to 
black for the printing of numerals and letters on license plates to 
accommodate the new digital printing process.  It also amends the 
plate reservation language to match current practice of a staggered 
replacement, and allows the registered plate owner the option of 
maintaining their current plate number in the year of replacement.                                                             
                                
                          FISCAL IMPACT

The plate manufacturing account will potentially see an increase 
of $256,000 to $424,000 (if current costs remain status quo).  
However, over the past 5 year history the costs to produce and 
manufacture plates has increased more than 30%.  If this trend 
continues at approximately 6% annually, then the revenue to the 
plate manufacturing account would decrease to the lower end of 
the revenue realized.  Any additional revenue that is not 
obligated, can by code, be transferred to the highway 
distribution account.

By moving to a 10 year replacement schedule, and implementing this 
replacement for all plates issued on and after the effective date, 
July 1, 2008, the department and Correctional Industries will not 
see the decrease in production until 2015 through 2018.  Because 
the department is currently in a 5 year contract with Correctional 
Industries, the fiscal impact cannot be estimated due to the 
expiration of the contract prior to the decrease in volumes.
