]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 371 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO THE MILITARY DIVISION; AMENDING SECTION 46-1202, IDAHO CODE, TO 3 TRANSFER THE IDAHO STATEWIDE INTEROPERABILITY EXECUTIVE COUNCIL TO THE 4 MILITARY DIVISION FROM THE IDAHO BUREAU OF HOMELAND SECURITY; AMENDING 5 SECTION 46-1203, IDAHO CODE, TO REVISE THE PURPOSE; AMENDING SECTION 6 46-1204, IDAHO CODE, TO REVISE COUNCIL RESPONSIBILITIES; AMENDING SECTION 7 46-1206, IDAHO CODE, TO PROVIDE DUTIES OF THE MILITARY DIVISION; AND 8 AMENDING SECTION 46-1207, IDAHO CODE, TO PROVIDE DUTIES OF THE ADJUTANT 9 GENERAL. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Section 46-1202, Idaho Code, be, and the same is hereby 12 amended to read as follows: 13 46-1202. IDAHO STATEWIDE INTEROPERABILITY EXECUTIVE COUNCIL. There is 14 hereby created in theIdaho bureau of homeland securitymilitary division the 15 Idaho statewide interoperability executive council to provide policy level 16 direction and promote efficient and effective use of resources for matters 17 related to public safety wireless radio interoperability. 18 SECTION 2. That Section 46-1203, Idaho Code, be, and the same is hereby 19 amended to read as follows: 20 46-1203. PURPOSE. The council will serve as the governing body in affairs 21 of public safety wireless radio interoperable communications for local and 22 private entities.and coordinate with the military division.The council will 23 promote interagency cooperation and provide support statewide for efficient 24 and effective use of local and private resources to achieve public safety 25 wireless radio interoperable communications for local and private public 26 safety agencies. 27 SECTION 3. That Section 46-1204, Idaho Code, be, and the same is hereby 28 amended to read as follows: 29 46-1204. COUNCIL RESPONSIBILITIES. The responsibilities of the council 30 are to: 31 (1) Develop a statewide plan for local and private public safety wireless 32 radio interoperable communications;in coordination and cooperation with the33military division;34 (2) Develop and adopt standards for local and private public safety wire- 35 less radio interoperable communications;in coordination and cooperation with36the military division;37 (3) Recommend guidelines and standards for operation for local and pri- 38 vate public safety wireless radio interoperable communications systems in 39 Idaho;in coordination and cooperation with the military division;2 1 (4) Promote coordination and cooperation among local, state, federal and 2 tribal public safety agencies in addressing statewide public safety wireless 3 radio interoperable communications needs in Idaho; 4 (5) Review priorities for statewide public safety wireless radio 5 interoperable communications needs and assist users of the statewide system in 6 the development of projects, plans, policies, standards, priorities and guide- 7 lines for public safety wireless radio interoperable communications;in coor-8dination and cooperation with the military division;9 (6) Develop funding recommendations for short-term and long-term system 10 maintenance; 11 (7) Research best practices of other states; 12 (8) Prepare and present a report to the information technology resource 13 management council by December 30 of each year describing the council's acts 14 and achievements of the previous year; 15 (9) Provide recommendations to the governor and the legislature of the 16 state of Idaho, when appropriate, concerning issues related to local and pri- 17 vate statewide public safety wireless radio interoperable communications in 18 Idaho and in accordance with homeland security presidential directives; 19 (10) Report annually to the legislature of the state of Idaho on the 20 planned expenditures for the next fiscal year, the collected revenues and 21 moneys disbursed from the Idaho statewide interoperability communications fund 22 and programs or projects in progress, completed or anticipated; 23 (11) Serve as a conduit for the future allocation of federal grant funds 24 to support the delivery of public safety wireless radio interoperable communi- 25 cations systems directed towards local government and private entities; 26 (12) Enter into contracts with experts and/or consultants as may be neces- 27 sary to carry out the purposes of this chapter and to sue and be sued; and 28 (13) Work in coordination and cooperation with the Idaho emergency commu- 29 nications commission established by section 31-4815, Idaho Code, and the 30 information technology resource management council, established by section 31 67-5745B, Idaho Code. 32 SECTION 4. That Section 46-1206, Idaho Code, be, and the same is hereby 33 amended to read as follows: 34 46-1206. IDAHO STATEWIDE INTEROPERABILITY EXECUTIVE COUNCIL COMMUNICA- 35 TIONS FUND -- ESTABLISHMENT AND ADMINISTRATION. (1) There is hereby created 36 within the treasury of the state of Idaho a separate fund known as the Idaho 37 statewide interoperability communications fund, which shall consist of moneys 38 received from the state, counties, cities, public safety communications opera- 39 tions, grants, donations, gifts and revenues from any other source to support 40 the delivery of public safety wireless radio interoperable communications sys- 41 tems throughout the state. 42 (2) Moneys in the fund are hereby continuously appropriated and shall be 43 utilized exclusively for the purposes set forth in this chapter as determined 44 by the council. 45 (3) The council, through theIdaho bureau of homeland securitymilitary 46 division, shall authorize disbursement of moneys in the fund to eligible enti- 47 ties and for the support of this council. 48 SECTION 5. That Section 46-1207, Idaho Code, be, and the same is hereby 49 amended to read as follows: 50 46-1207. ADMINISTRATIVE SUPPORT. The council may, with concurrence of the 51 governor of the state of Idaho, create the position of a project manager and 3 1 the position of an administrative assistant, which positions shall be exempt 2 from the requirements of the merit system, chapter 53, title 67, Idaho Code. 3 In accordance with the laws of the state, theIdaho bureau of homeland4security's directoradjutant general may hire, fix the compensation and pre- 5 scribe the powers and duties of such other individuals, including consultants, 6 as may be necessary to carry out the provisions of this chapter.
STATEMENT OF PURPOSE RS 17344C1 Correct a problem by amending the State Interoperability Executive Council (SIEC) authorizing language in Idaho Code Title 46, chapter 12, to correctly identify the location of the SIEC within the Military Division (Id.
