  1                                        AN ACT
  2    RELATING TO WATER; REPEALING SECTION 42-620, IDAHO CODE, RELATING  TO  CERTAIN
  3        WATER DISTRICT EXPENSES; AND AMENDING CHAPTER 17, TITLE 42, IDAHO CODE, BY
  4        THE ADDITION OF A NEW SECTION 42-1779, IDAHO CODE, TO PROVIDE FOR A STATE-
  5        WIDE COMPREHENSIVE AQUIFER PLANNING AND MANAGEMENT EFFORT.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION  1.  That  Section  42-620, Idaho Code, be, and the same is hereby
  8    repealed.

  9        SECTION 2.  That Chapter 17, Title 42, Idaho Code, be,  and  the  same  is
 10    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 11    ignated as Section 42-1779, Idaho Code, and to read as follows:

 12        42-1779.  STATEWIDE COMPREHENSIVE AQUIFER PLANNING AND MANAGEMENT  EFFORT.
 13    Pursuant  to the provisions of Idaho law and legislative funding approval, the
 14    Idaho water resource board and the Idaho department of water  resources  shall
 15    conduct  a statewide comprehensive aquifer planning and management effort over
 16    a ten (10) year period of time beginning in fiscal year 2009. Funding for  the
 17    statewide  comprehensive  aquifer planning and management effort shall be used
 18    for technical studies, facilitation services, hydrologic monitoring,  measure-
 19    ment  and comprehensive plan development as well as for personnel costs, oper-
 20    ating expenses and capital outlay associated with the statewide  comprehensive
 21    aquifer planning and management effort.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS 17715

The purpose of Section 1 of this legislation is to repeal Section 42-620, Idaho 
Code, that requires assessments to be made to all water users of water 
hydraulically connected to the Eastern Snake Plain Aquifer to be collected by the 
Department of Water Resources.  The funding of the completion of the planning 
effort underway for the ESPA is provided in new Section 42-1779. The new Section
42-1779 provides for a statewide comprehensive aquifer planning and management 
effort over a ten (10) year period.



                           FISCAL NOTE

The Department of Water Resources has requested and the Governor has recommended 
$20 million from the General Fund beginning in fiscal year 2009 to conduct a 
statewide comprehensive aquifer planning and management effort.  The Department is 
requesting that $18.4 million be appropriated and transferred from the General 
Fund to the Water Resource Board Revolving Development Fund for technical studies, 
facilitation services, hydrologic monitoring, measurement and comprehensive plan 
development associated with the aquifer planning and management effort. The Water
Resource Board Revolving Development Fund is established in 42-1752, Idaho Code. 
The Department of Water Resources is also requesting $1.6 million be appropriated 
and transferred from the General Fund to the Water Administration Fund for 
personnel costs, operating expenses, and capital purchases associated with the 
planning and management effort.  The Water Administration Fund is established in 
42-238a, Idaho Code.
