]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 452 BY BUSINESS COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO CONTRACTORS BOARD; AMENDING SECTION 54-5206, IDAHO CODE, 3 TO REVISE COMPENSATION FOR BOARD MEMBERS. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 54-5206, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 54-5206. IDAHO CONTRACTORS BOARD. (1) The Idaho contractors board is 8 hereby created and made a part of the bureau of occupational licenses. It 9 shall be the responsibility and duty of the bureau chief to administer this 10 chapter, and the bureau chief shall exercise such powers and duties as are 11 reasonably necessary to enforce the provisions of this chapter. The board may 12 promulgate such rules as may be necessary to carry out the provisions of this 13 chapter in order to effectuate the purposes herein and for the orderly and 14 efficient administration thereof, except as may be limited or prohibited by 15 law and the provisions of this chapter. 16 (2) The board shall consist of four (4) members who are contractors, and 17 one (1) member of the public at large, all of whom shall be appointed by the 18 governor as follows: one (1) contractor from the northern district consisting 19 of Idaho, Lewis, Nez Perce, Clearwater, Latah, Benewah, Boundary, Shoshone, 20 Kootenai and Bonner counties; one (1) contractor from the southeastern dis- 21 trict consisting of Lemhi, Butte, Clark, Fremont, Jefferson, Madison, Teton, 22 Bonneville, Bingham, Caribou, Bear Lake, Franklin, Oneida, Power and Bannock 23 counties; one (1) contractor from the southwestern district consisting of Owy- 24 hee, Elmore, Ada, Canyon, Boise, Gem, Payette, Washington, Adams and Valley 25 counties; one (1) contractor from the south central district consisting of 26 Blaine, Camas, Cassia, Custer, Gooding, Jerome, Lincoln, Minidoka and Twin 27 Falls counties; and one (1) member of the public at large who resides in the 28 state of Idaho and is a person of integrity and good reputation who has lived 29 in this state for at least five (5) years immediately preceding appointment, 30 who has never been registered as a contractor in this or another state, and 31 who has never had a substantial personal, business, professional or pecuniary 32 connection with a contractor except as a purchaser or owner of real property. 33 (3) Each member of the board who is a contractor shall serve a term of 34 four (4) years and such terms shall be staggered. The initial board shall have 35 one (1) member whose term expires July 1, 2007; one (1) member whose term 36 expires July 1, 2008; one (1) member whose term expires July 1, 2009; and one 37 (1) member whose term shall expire July 1, 2010. The member of the board who 38 is a member of the public at large shall serve a four (4) year term, which 39 initial term shall expire on July 1, 2008. No member of the board may be 40 appointed to more than two (2) consecutive terms. 41 (4) The board shall meet within thirty (30) days after the appointment of 42 all its members and thereafter at such other times as may be expedient and 43 necessary for the proper performance of its duties, but not less than once 2 1 during each calendar quarter. At the board's first meeting, the members shall 2 elect one (1) of their number to be chairman. The chairman may serve in such 3 capacity for a one (1) year term and may not serve in such capacity for more 4 than two (2) consecutive terms. A majority of the board shall constitute a 5 quorum for the transaction of business. 6 (5) The board may delegate to the bureau chief: 7 (a) The power to perform ministerial functions, investigate and disci- 8 pline, hold hearings, appoint hearing officers, summon witnesses to 9 appear, administer oaths and take affirmations of witnesses at any formal 10 proceeding or before a duly appointed hearing officer; 11 (b) The power to appoint competent persons to issue subpoenas, administer 12 oaths and take testimony; and 13 (c) The power to enforce orders of the board. 14 (6) Each member of the board shall be compensated as provided by section 15 59-509(bn), Idaho Code. 16 (7) On and after January 1, 2006, each member of the board who is a con- 17 tractor shall be registered in accordance with this chapter and shall be in 18 good standing.
STATEMENT OF PURPOSE RS 17363 This bill will change the compensation for members of the board of contractors to allow compensation at the rate of $50.00 per day for conducting board business. FISCAL IMPACT There is no impact on general funds. The impact on dedicated funds would be approximately $1000.00 per year.
