]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 472 BY RESOURCES AND CONSERVATION COMMITTEE 1 AN ACT 2 RELATING TO FISH AND GAME; AMENDING SECTION 36-406A, IDAHO CODE, TO PROVIDE 3 FOR TWO POLE PERMITS AND TO PROVIDE FOR PERMITS TO USE AS INDIVIDUALS FOR 4 CERTAIN PERSONS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 36-406A, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 36-406A. TWO POLEVALIDATIONPERMIT. The commission is authorized to pro- 9 mulgate rules specifying seasons and waters where a resident or nonresident 10 mayapply for a validation to be placed on their fishing licensepurchase a 11 permit authorizing the person to use two (2) poles on waters that have been 12 designated as "two pole" waters by commission rule subject to payment of a fee 13 as specified in section 36-416, Idaho Code. A person who has avalidationtwo 14 pole permit may utilize two (2) poles to fish with during the season so speci- 15 fied by commission rule and on the waters so specified by commission rule. 16 Bona fide residents of Idaho who are expressly exempt from license require- 17 ments to fish in the public waters of the state may purchase a permit to use 18 as an individual pursuant to this section as specified by commission rule. 19 Unlicensed nonresident children under the age of fourteen (14) years shall be 20 eligible to purchase a permit to use as an individual if accompanied by a 21 holder of a valid license and provided that any fish caught by such nonresi- 22 dent children shall be included in the bag and possession limit of such 23 license holder.
STATEMENT OF PURPOSE
RS 17725
The purpose of this legislation is to amend existing law
to revise terminology to provide for a two (2) pole permit and
to allow persons exempt from purchasing a fishing license to
purchase a two pole permit. This will allow children exempt
from licensing to fish with a two pole permit, similar to
provisions of 36-410(b) and (c) for steelhead trout and
anadromous salmon permits.
FISCAL NOTE
There will be no fiscal impact to the State. There will
be no fiscal effect to Fish and Game funds by revising the two
pole validation to become a two pole permit. Allowing
residents and non-residents, who are exempt from purchasing a
fishing license, to purchase a two pole permit is estimated to
increase sales of the two pole permit by no more than 5% of
the 2006 sales for a total increase to Fish and Game funds of
$14,712.
