]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 477 BY BUSINESS COMMITTEE 1 AN ACT 2 RELATING TO MANUFACTURED HOME DEALER AND INSTALLER LICENSING; AMENDING SECTION 3 44-2101A, IDAHO CODE, TO REVISE A DEFINITION. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 44-2101A, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 44-2101A. DEFINITIONS. As used in this chapter: 8 (1) "Administrator" means the administrator of the division of building 9 safety of the state of Idaho. 10 (2) "Board" means the manufactured housing board established in section 11 44-2104, Idaho Code. 12 (3) "Engaged in the business" means the individual or entity buys, sells, 13 brokers, trades, or offers for resale a manufactured or mobile home. 14 (4) "Installer" means a person who owns a business that installs or ser- 15 vices a manufactured home or mobile home at the site where it is to be used 16 for occupancy. 17 (5) "Manufactured home" or "manufactured house" means a structure as 18 defined in section 39-4105, Idaho Code. 19 (6) "Manufacturer" means any person engaged in the business of manufac- 20 turing manufactured homes that are offered for sale, lease or exchange in the 21 state of Idaho. 22 (7) "Mobile home" means a structure as defined in section 39-4105, Idaho 23 Code. 24 (8) "Person" means a natural person, corporation, partnership, trust, 25 society, club, association or other organization. 26 (9) "Place of business" refers to any physical location at which the 27 business is lawfully conducted. 28 (10) "Resale broker" means any person engaged in the business of selling 29 broker-owned, used, third-party owned, or other resale of manufactured or 30 mobile homes. 31 (11) "Responsible managing employee" or "RME" means the person designated 32 by the retailer, installer, manufacturer, service company or resale broker to 33 supervise other employees, either personally or through others. 34 (12) "Retailer" means any person engaged in the business of selling or 35 exchanging new, used, resale or brokered manufactured or mobile homes. 36 (13) "Salesman" means any person employed by a retailer or resale broker 37 for a salary, commission or compensation of any kind to sell, list, purchase 38 or exchange or to negotiate for the sale, listing, purchase or exchange of 39 new, used, brokered or third-party owned units, except as otherwise provided 40 in this chapter. 41 (14) "Service company" means any person other than an installer who pro- 42 vides service, repair or tear down of manufactured or mobile homes.
STATEMENT OF PURPOSE
RS 17408
2007 House Bill No. 100 revised the definition of “Responsible
managing employee,” inadvertently leaving out some practitioners
who traditionally were covered by this definition. This has
adversely affected some service providers. Adding additional
language to the existing definition corrects this problem.
