                         BY COMMERCE AND HUMAN RESOURCES COMMITTEE

  1                                        AN ACT
  2    RELATING TO WORKER'S COMPENSATION AND RELATED LAWS; AMENDING CHAPTER 9,  TITLE
  3        72,  IDAHO  CODE, BY THE ADDITION OF A NEW SECTION 72-928A, IDAHO CODE, TO
  4        PROVIDE THAT A PUBLIC CORPORATION MAY INSURE AGAINST LIABILITY FOR COMPEN-
  5        SATION WITH THE STATE INSURANCE FUND OR WITH  CERTAIN  LICENSED  INSURANCE
  6        CARRIERS.

  7    Be It Enacted by the Legislature of the State of Idaho:

  8        SECTION  1.  That  Chapter  9,  Title  72, Idaho Code, be, and the same is
  9    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 10    ignated as Section 72-928A, Idaho Code, and to read as follows:

 11        72-928A.  INSURANCE BY PUBLIC CORPORATIONS. Notwithstanding the provisions
 12    of section 72-928(a), Idaho Code, relating to procuring insurance against lia-
 13    bility for compensation, a public corporation may insure against its liability
 14    for  compensation  with  the  state  insurance fund or with any other licensed
 15    insurance carrier providing such liability coverage.

Statement of Purpose / Fiscal Impact



                         STATEMENT OF PURPOSE

                               RS 17770

Currently in Idaho Code, public corporations, such as city and county
governments and school districts, may only insure against liability 
for workers compensation through the State Insurance Fund.  This
legislation would amend Chapter 9 of Title 72 to permit public 
corporations to solicit bids for workers compensation liability 
insurance from private insurance carriers.


                             FISCAL NOTE

None, however should public entities choose to take advantage of this 
legislation and receive a lower premium rate from a private surety 
there could be a cost savings in public entity budgets.
