  1                                        AN ACT
  2    RELATING TO MANAGED CARE REFORM; AMENDING SECTION 41-3932, IDAHO CODE, TO PRO-
  3        VIDE THAT THE MANAGED CARE REFORM ACT SHALL NOT APPLY TO CERTAIN  PROGRAMS
  4        ADMINISTERED  BY  THE  DEPARTMENT OF HEALTH AND WELFARE AND TO PROVIDE FOR
  5        RULES.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION 1.  That Section 41-3932, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:

  9        41-3932.  EXEMPTIONS  FROM  APPLICATION OF CHAPTER. This chapter shall not
 10    apply to managed care programs operated under contract with the  federal  gov-
 11    ernment  under  title  XVIII  of  the  federal social security act, as amended
 12    (medicare), or under contract with a plan otherwise exempt from  operation  of
 13    this  chapter pursuant to the employee retirement income security act of 1974,
 14    as amended (ERISA). This chapter shall not apply to programs  administered  by
 15    the  department  of  health  and welfare under contract with the department of
 16    health and welfare under title XIX of the  federal  social  security  act,  as
 17    amended  (medicaid) or under programs administered by the department of health
 18    and welfare substance use disorder bureau or its contracted managed care orga-
 19    nization, as amended (substance abuse funding). The director shall  take  such
 20    actions and promulgate such rules as shall be necessary to effectuate the pro-
 21    visions of this section.

                       STATEMENT OF PURPOSE

                             RS 17745

This proposed legislation seeks to add an exempted entity to Idaho code Title
41 chapter 3932.  Currently the application of a new substance use disorder
treatment provider falls under a statute written to address managed care
reform.  Under this statute the state has no ability to manage needed
treatment capacity levels geographically.  This has created the situation
where we have too many providers in some areas and not enough in others.  As a
result we spread services so thinly in those areas with a number of providers
that all providers struggle to stay open, while other areas have no substance
use disorder treatment available to those who need it.

Legislation incurs no additional fiscal impact.
