  2    RELATING TO HIGHWAY DISTRICT ELECTIONS; AMENDING SECTION 40-1305A, IDAHO CODE,
  3        TO PROVIDE THAT HIGHWAY DISTRICT ELECTIONS SHALL BE  CONDUCTED  IN  ACCOR-
  4        DANCE WITH THE GENERAL LAWS OF THE STATE INCLUDING THE PROVISIONS OF CHAP-
  5        TER  14,  TITLE 34, IDAHO CODE; AND REPEALING SECTIONS 40-1305B, 40-1305C,
  6        40-1305D, 40-1305E,  40-1305F,  40-1305G,  40-1305H,  40-1305I,  40-1305J,
  7        40-1305K,  40-1305L,  40-1305M,  40-1305N,  40-1305O,  40-1305P, 40-1305Q,
  8        40-1305AA,  40-1305BB,   40-1305CC,   40-1305DD,   40-1305EE,   40-1305FF,
  9        40-1305GG,   40-1305HH,   40-1305II,   40-1305JJ,   40-1305KK,  40-1305LL,

 12        AND ADMINISTERED ACCORDING TO HIGHWAY DISTRICT LAW.

 13    Be It Enacted by the Legislature of the State of Idaho:

 14        SECTION 1.  That Section 40-1305A, Idaho Code, be, and the same is  hereby
 15    amended to read as follows:

 16        40-1305A.  ELECTION  ADMINISTRATION.  Highway district commissioners shall
 17    have authority to administer highway district elections shall be conducted  in
 18    accordance  with  the  provisions  of  this chapter general laws of the state,
 19    including the provisions of chapter 14, title 34, Idaho Code. The  commission-
 20    ers  shall select polling places and appoint an election official and election
 21    judges and clerks and set their compensation. In all matters not  specifically
 22    covered  by this chapter, the provisions of title 34, Idaho Code, shall govern
 23    the procedure for highway district elections.
 24        Highway districts may contract with the county clerk  to  conduct  all  or
 25    part of the elections for a highway district. In the event of such a contract,
 26    the  county  clerk shall perform all necessary duties of the election official
 27    of a highway district including, but not limited  to,  notice  of  the  filing
 28    deadline, notice of the election, and preparation of the election calendar.

 29        SECTION   2.  That   Sections   40-1305B,  40-1305C,  40-1305D,  40-1305E,
 30    40-1305F,  40-1305G,  40-1305H,  40-1305I,   40-1305J,   40-1305K,   40-1305L,
 31    40-1305M,   40-1305N,  40-1305O,  40-1305P,  40-1305Q,  40-1305AA,  40-1305BB,
 32    40-1305CC, 40-1305DD, 40-1305EE, 40-1305FF, 40-1305GG,  40-1305HH,  40-1305II,
 33    40-1305JJ,  40-1305KK,  40-1305LL, 40-1305MM, 40-1305NN, 40-1305OO, 40-1305PP,
 34    40-1305QQ, 40-1305RR and 40-1305SS, Idaho Code, be, and the  same  are  hereby
 35    repealed.

Statement of Purpose / Fiscal Impact


                    STATEMENT OF PURPOSE

                          RS 17861
                              
  This legislation amends Title 40, Chapter 13, Idaho Code,
  relating to the elections of highway district commissioners. 
  The codes being repealed in this legislation are duplicitous
  with language found in the regular election law found in
  Title 34, Idaho Code.  This legislation makes the process of
  election of highway district commissioners uniform with
