]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 534 BY REVENUE AND TAXATION COMMITTEE 1 AN ACT 2 RELATING TO LOCAL LAND USE PLANNING; AMENDING CHAPTER 65, TITLE 67, IDAHO 3 CODE, BY THE ADDITION OF A NEW SECTION 67-6511B, IDAHO CODE, TO PROVIDE 4 FOR THE DEVELOPMENT OF AFFORDABLE WORKFORCE HOUSING. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Chapter 65, Title 67, Idaho Code, be, and the same is 7 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 8 ignated as Section 67-6511B, Idaho Code, and to read as follows: 9 67-6511B. DEVELOPMENT OF AFFORDABLE WORKFORCE HOUSING. (1) Each governing 10 board may, by ordinance adopted or amended in accordance with the notice and 11 hearing provisions provided under section 67-6509, Idaho Code, require as a 12 condition for obtaining a residential building permit that an owner or develo- 13 per develop or ensure development of affordable workforce housing generated by 14 the proposed construction either onsite or on an eligible site as determined 15 by the governing board prior to or concurrent with the issuance of any build- 16 ing permit for the proposed new residential construction. 17 (2) The ordinance may require that the owner or developer pay a fee in 18 lieu of onsite or eligible site development of affordable workforce housing as 19 provided for in subsection (1) of this section. The fee permitted by this sub- 20 section shall not be deemed an impact fee as defined in section 67-8203, Idaho 21 Code.
STATEMENT OF PURPOSE

This legislation will amend chapter 65, title 67 of Idaho Code
concerning the development of affordable workforce housing. The
legislation will establish the requirement for owners or
developers obtaining a residential building permit to develop or
ensure the development of affordable workforce housing either
onsite or on a site deemed eligible by the governing board. The
legislation may require the owner or developer to pay a fee in
lieu of onsite or eligible site development of affordable
workforce housing.
FISCAL NOTE
No impact to the general fund. Any costs are to be determined at
the local level.
