  2    RELATING TO CHANGE OF NAMES; AMENDING SECTION 7-802, IDAHO  CODE,  TO  PROVIDE
  3        THAT  A  CRIMINAL  BACKGROUND  CHECK  BE FILED WITH PETITION FOR CHANGE OF
  4        NAME.

  5    Be It Enacted by the Legislature of the State of Idaho:

  6        SECTION 1.  That Section 7-802, Idaho Code, be, and  the  same  is  hereby
  7    amended to read as follows:

  8        7-802.  PETITION  FOR CHANGE. All applications for change of names must be
  9    made to the district court of the county where the person whose name  is  pro-
 10    posed  to  be changed resides, by petition, signed by such person; and if such
 11    person is under the age of eighteen (18) years, by one (1) of the parents,  if
 12    living; or if both be dead, then by the guardian; and if there be no guardian,
 13    then  by  some near relative or friend. The petition must specify the place of
 14    birth and residence of such person, his or her present  name,  the  name  pro-
 15    posed,  and  reason  for  such change of name, and must, if the father of such
 16    person be not living, name, as far as known to the petitioner, the near  rela-
 17    tives  of  such  person,  and  their  place of residence. The petitioner shall
 18    include as part of the application for change of name, a  criminal  background
 19    check,  dated  within  thirty (30) days of the date of filing the petition for
 20    change of name.

This proposed legislation would amend Idaho Code, Section 7-802,
making a criminal background check a part of the application for
a petitioner's change of name.



                            FISCAL NOTE

There would be no fiscal impact to the General Fund.
