DISABILITIES SERVICES - Appropriates $17,881,800 to the Department of
Health and Welfare for the Community Developmental Disabilities Services
Program for fiscal year 2009; limits the authorized full-time equivalent
positions for the Community Developmental Disabilities Services Program to
167.92; appropriates $25,740,800 to the Department of Health and Welfare
for the Idaho State School and Hospital Program for fiscal year 2009;
limits the authorized full-time equivalent positions for the Idaho State
School and Hospital Program to 375.53; authorizes the State Controller to
make transfers to the Cooperative Welfare Fund; directs that funds for
trustee and benefit payments shall not be transferred; and provides intent
regarding intensive behavioral intervention services.

  2    APPROPRIATING MONEYS TO THE DEPARTMENT OF HEALTH AND WELFARE FOR SERVICES  FOR
  3        THE  DEVELOPMENTALLY  DISABLED  IN  THE COMMUNITY DEVELOPMENTAL DISABILITY
  4        SERVICES PROGRAM FOR FISCAL YEAR 2009; LIMITING THE  NUMBER  OF  FULL-TIME
  5        EQUIVALENT  POSITIONS  FOR THE COMMUNITY DEVELOPMENTAL DISABILITY SERVICES
  6        PROGRAM; APPROPRIATING MONEYS TO THE DEPARTMENT OF HEALTH AND WELFARE  FOR
  7        SERVICES  FOR  THE  DEVELOPMENTALLY DISABLED IN THE IDAHO STATE SCHOOL AND
  8        HOSPITAL PROGRAM FOR FISCAL YEAR 2009; LIMITING THE  NUMBER  OF  FULL-TIME
  9        EQUIVALENT POSITIONS FOR THE IDAHO STATE SCHOOL AND HOSPITAL PROGRAM; PRO-
 10        VIDING  THAT  THE  STATE  CONTROLLER SHALL MAKE TRANSFERS FROM THE GENERAL
 11        FUND; DIRECTING THAT THE FUNDS FOR TRUSTEE AND BENEFIT PAYMENTS SHALL  NOT
 12        BE TRANSFERRED; AND EXPRESSING LEGISLATIVE INTENT WITH REGARD TO INTENSIVE
 13        BEHAVIORAL INTERVENTION.

 14    Be It Enacted by the Legislature of the State of Idaho:

 15        SECTION  1.  There  is hereby appropriated to the Department of Health and
 16    Welfare for services for the developmentally disabled in the Community  Devel-
 17    opmental  Disability  Services  Program  the  following amounts to be expended
 18    according to the designated expense classes from  the  listed  funds  for  the
 19    period July 1, 2008, through June 30, 2009:

 34        SECTION  2.  FULL-TIME  EQUIVALENT  POSITIONS.  In accordance with Section
 35    67-3519, Idaho Code, the Department of Health and  Welfare  is  authorized  no
 36    more than one hundred sixty-seven and ninety-two hundredths (167.92) full-time
 37    equivalent  positions for the Community Developmental Disability Services Pro-
 38    gram during the period July 1, 2008, through June 30, 2009. Transfers of full-
 39    time equivalent positions between appropriated programs within the  department
 40    are  authorized and shall be reported in the budget prepared for the next fis-
 41    cal year. Any full-time equivalent positions in  excess  of  the  department's
 42    total  cap may be authorized only by the Governor and promptly reported to the
 43    Joint Finance-Appropriations Committee.

  3    School and Hospital Program the following amounts to be expended  according to

 22        SECTION  4.  FULL-TIME  EQUIVALENT  POSITIONS.  In accordance with Section
 23    67-3519, Idaho Code, the Department of Health and  Welfare  is  authorized  no
 24    more than three hundred seventy-five and fifty-three hundredths (375.53) full-
 25    time equivalent positions for the Idaho State School and Hospital Program dur-
 26    ing  the  period  July  1, 2008, through June 30, 2009. Transfers of full-time
 27    equivalent positions between appropriated programs within the  department  are
 28    authorized  and  shall  be reported in the budget prepared for the next fiscal
 29    year. Any full-time equivalent positions in excess of the  department's  total
 30    cap  may be authorized only by the Governor and promptly reported to the Joint
 31    Finance-Appropriations Committee.

 32        SECTION 5.  GENERAL FUND TRANSFERS. As appropriated, the State  Controller
 33    shall  make  transfers  from the General Fund to the Cooperative Welfare Fund,
 34    periodically, as requested by the director of the  Department  of  Health  and
 35    Welfare and approved by the Board of Examiners.

 36        SECTION  6.  TRUSTEE  AND BENEFIT PAYMENTS. Notwithstanding the provisions
 37    of Section 67-3511, Idaho Code, funds budgeted in the trustee and benefit pay-
 38    ments expenditure object code shall not be transferred to  any  other  objects
 39    within the program budget during fiscal year 2009.

 40        SECTION  7.  INTENSIVE  BEHAVIORAL  INTERVENTION.  It is the intent of the
 41    Legislature that  the  Community  Developmental  Disability  Services  Program
 42    report  back on the status regarding growth in the use of intensive behavioral
 43    intervention services to the Joint Finance-Appropriations Committee during its
 44    2009 budget hearing. The report shall include the last five (5) years'  growth
 45    history and the outcomes and effects the additional five (5) full-time equiva-
 46    lent positions have had on the program.
