  2    RELATING TO INCOME  TAX  CREDITS  FOR  RESEARCH  ACTIVITY;  REPEALING  SECTION
  3        63-3029G,  IDAHO  CODE,  RELATING  TO CREDITS FOR RESEARCH ACTIVITIES CON-
  4        DUCTED IN THIS STATE.

  5    Be It Enacted by the Legislature of the State of Idaho:

  6        SECTION 1.  That Section 63-3029G, Idaho Code, be, and the same is  hereby
  7    repealed.

                              HOUSE AMENDMENT TO H.B. NO. 664

  1                                AMENDMENTS TO THE BILL
  2        On page 1 of the printed bill, following line 7, insert:

  3        "SECTION 2. That Chapter 30, Title 63, Idaho Code, be,  and  the  same  is
  4    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  5    ignated as Section 63-3029G, Idaho Code, and to read as follows:

  6        63-3029G.  CARRYOVER OF CREDIT FOR RESEARCH ACTIVITIES CONDUCTED  IN  THIS
  7    STATE.  A  taxpayer  entitled  to the carryover of credit accruing pursuant to
  8    section 63-3029G, Idaho Code, as in effect on December 31, 2008,  for  taxable
  9    years  beginning  before  January  1, 2009, shall be entitled to carryover the
 10    credit in the amounts and subject  to  the  limitations  provided  in  section
 11    63-3029G, Idaho Code, as in effect on December 31, 2009.

 12        SECTION 3. This act shall be in full force and effect on and after January
 13    1, 2009.".

 14                                 CORRECTIONS TO TITLE
 15        On  page  1,  in line 4, following "STATE" insert: "; AMENDING CHAPTER 30,
 16    TITLE 63, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 63-3029G,  IDAHO  CODE,
 17    TO  PROVIDE  FOR CARRYOVER OF CREDIT FOR RESEARCH ACTIVITIES CONDUCTED IN THIS
 18    STATE; AND PROVIDING AN EFFECTIVE DATE".

  4        DUCTED IN THIS STATE; AMENDING CHAPTER 30, TITLE 63, IDAHO  CODE,  BY  THE
  5        ADDITION  OF  A NEW SECTION 63-3029G, IDAHO CODE, TO PROVIDE FOR CARRYOVER
  6        OF CREDIT FOR RESEARCH ACTIVITIES CONDUCTED IN THIS STATE;  AND  PROVIDING

  8    Be It Enacted by the Legislature of the State of Idaho:

  9        SECTION  1.  That Section 63-3029G, Idaho Code, be, and the same is hereby
 10    repealed.

 11        SECTION 2.  That Chapter 30, Title 63, Idaho Code, be,  and  the  same  is
 12    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 13    ignated as Section 63-3029G, Idaho Code, and to read as follows:

 14        63-3029G.  CARRYOVER OF CREDIT FOR RESEARCH ACTIVITIES CONDUCTED  IN  THIS
 15    STATE.  A  taxpayer  entitled  to the carryover of credit accruing pursuant to
 16    section 63-3029G, Idaho Code, as in effect on December 31, 2008,  for  taxable

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 18123

     The purpose of this legislation is to repeal Section 63-
3029G of Idaho Code which grants a 5% tax credit for research
activities.  This legislation is the result of the
recommendations from the Interim Committee on Exemptions.  


                           FISCAL NOTE

     Estimated increase to general fund $1,399,000 for 2009.
