]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 667 BY APPROPRIATIONS COMMITTEE 1 AN ACT 2 APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF ENVIRONMENTAL QUALITY FOR 3 FISCAL YEAR 2009; AND AUTHORIZING TWO ADDITIONAL FULL-TIME EQUIVALENT 4 POSITIONS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. In addition to any other appropriation provided by law, there 7 is hereby appropriated to the Department of Environmental Quality the follow- 8 ing amount to be expended for the designated program for agricultural smoke 9 management and crop residue disposal according to the designated expense 10 classes from the listed fund for the period July 1, 2008, through June 30, 11 2009: 12 AIR QUALITY: 13 FOR: 14 Personnel Costs $296,000 15 Operating Expenditures 190,200 16 Capital Outlay 120,200 17 TOTAL $606,400 18 FROM: 19 General Fund $606,400 20 SECTION 2. In addition to any other authorization provided by law, the 21 Department of Environmental Quality is hereby authorized two (2) additional 22 full-time equivalent positions for the period July 1, 2008, through June 30, 23 2009.

This is a trailer appropriation bill to the Department of Environmental Quality in the amount of $606,400 from the General Fund. This bill trails H557 which repealed the Smoke Management and Crop Residue Disposal Act administered by the Idaho Department of Agriculture and created a new statute providing the Department of Environmental Quality with the authority to administer a statewide program for the open burning of crop residue.

The appropriation provides $606,400 from the General Fund as follows: $296,000 for two new full-time positions, nine seasonal staff, and additional hours for meteorological and technical air monitoring staff; $190,200 in operating expenditures for media outreach, weather forecasting services, vehicle leases, and contract moneys to develop a web-based information system; and $120,200 for seven air quality monitors, laptop computers, and office equipment. Of the total, $419,700 is ongoing and $186,700 is one-time.
H557 directs the Department of Agriculture to transfer all moneys remaining in the Smoke Management Fund to the General fund effective June 30, 2008. That balance is about $209,000. H557 sets a $2 per acre fee for burning agricultural fields and directs those receipts to the General Fund. The one-time transfer of $209,000 will be used to offset first year costs and, in the future, it is estimated that it will take approximately 210,000 registered and paid acres to offset the annual program costs.
