]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 669 BY APPROPRIATIONS COMMITTEE 1 AN ACT 2 RELATING TO THE APPROPRIATION FOR THE PUBLIC SCHOOLS DIVISION OF TEACHERS FOR 3 FISCAL YEAR 2009; PROVIDING FOR EXPENDITURES FOR THE PUBLIC SCHOOLS DIVI- 4 SION OF TEACHERS; APPROPRIATING GENERAL FUND MONEYS FOR TRANSFER TO THE 5 PUBLIC SCHOOL INCOME FUND; APPROPRIATING FUNDS TO THE EDUCATIONAL SUPPORT 6 PROGRAM/DIVISION OF TEACHERS FOR FISCAL YEAR 2009; PROVIDING MONEYS FOR 7 THE UNEMPLOYMENT INSURANCE PROGRAM; DIRECTING THAT AN AMOUNT BE DISTRIB- 8 UTED FOR MASTER TEACHER AWARD PAYMENTS; DIRECTING THE DISTRIBUTION OF 9 $1,000,000 BETWEEN TRAINING TO SERVE THE NEEDS OF GIFTED AND TALENTED STU- 10 DENTS AND TRAINING TEACHERS TO PROVIDE ADDITIONAL ADVANCED LEARNING OPPOR- 11 TUNITIES FOR STUDENTS; DIRECTING THAT $350 BE DISTRIBUTED TO EACH QUALI- 12 FIED TEACHER FOR CLASSROOM SUPPLIES; AMENDING SECTION 33-1004E, IDAHO 13 CODE, TO PROVIDE FOR A BASE SALARY INCREASE FOR INSTRUCTIONAL STAFF, TO 14 REVISE INSTRUCTIONAL SALARY ALLOCATION INCREASES AND TO INCREASE THE MINI- 15 MUM INSTRUCTIONAL STAFF SALARY; AND DIRECTING THAT $50,000 BE ALLOCATED 16 FOR A TEACHER PERFORMANCE EVALUATION TASK FORCE. 17 Be It Enacted by the Legislature of the State of Idaho: 18 SECTION 1. The following amount shall be expended for the Public Schools 19 Division of Teachers for the period July 1, 2008, through June 30, 2009: 20 FROM: 21 General Fund $746,380,700 22 Federal Grant Fund 70,693,800 23 TOTAL $817,074,500 24 SECTION 2. There is hereby appropriated the following amount to be trans- 25 ferred to the Public School Income Fund for the period July 1, 2008, through 26 June 30, 2009: 27 FROM: 28 General Fund $746,380,700 29 SECTION 3. There is hereby appropriated to the Educational Support 30 Program/Division of Teachers, pursuant to law and the provisions of this act, 31 the following amount to be expended from the listed funds for the period July 32 1, 2008, through June 30, 2009: 33 FROM: 34 Public School Income Fund $746,380,700 35 Federal Grant Fund 70,693,800 36 TOTAL $817,074,500 37 SECTION 4. Of the moneys appropriated in Section 3 of this act, the 38 amount necessary for the Unemployment Insurance Program shall be expended 39 according to Section 72-1349A, Idaho Code, for the period July 1, 2008, 40 through June 30, 2009. 2 1 SECTION 5. Of the moneys appropriated in Section 3 of this act, the 2 amount necessary shall be awarded to those instructional staff members who 3 have been recognized as master teachers by the National Board for Professional 4 Teaching Standards, according to the provisions of Section 33-1004E, Idaho 5 Code. 6 SECTION 6. Of the moneys appropriated in Section 3 of this act, 7 $1,000,000 shall be distributed as follows: 8 (1) $500,000 shall be distributed to train general education teachers, 9 gifted/talented (G/T) facilitators, administrators and/or parents to better 10 meet the needs of gifted/talented students. One-half (1/2) of these funds 11 shall be allocated pro rata based on each district's prior year total student 12 enrollment compared to the prior year total statewide enrollment. One-half 13 (1/2) of these funds shall be allocated based on the number of gifted/talented 14 students identified and served as indicated on the prior year's December 1 15 child count. The number of gifted/talented students identified for purposes of 16 this section shall not exceed seven percent (7%) of the district's total stu- 17 dent enrollment. No district shall receive less than $500. Funds shall be dis- 18 tributed upon submission and approval of an application submitted to the State 19 Department of Education demonstrating how in-service training will establish 20 or improve identification and service of gifted/talented students in the five 21 (5) mandated talent areas. The Superintendent of Public Instruction may real- 22 locate any gifted/talented funds that are left unrequested by school districts 23 to all other school districts that have requested gifted/talented funds, 24 according to the distribution formula outlined in this section. 25 (2) Pursuant to the fiscal impact statement for State Board of Education 26 rule, IDAPA 08.02.03, Docket Number 08-0203-0605, $500,000 shall be distrib- 27 uted to train teachers to provide advanced learning opportunities for stu- 28 dents. The allocation and utilization of such funds shall be determined 29 jointly by the State Board of Education and the Superintendent of Public 30 Instruction, under the administration of the State Department of Education, 31 provided that the funds not be used for state personnel costs. 32 SECTION 7. Of the moneys appropriated in Section 3 of this act, $350 33 shall be distributed to each full-time equivalent certificated classroom 34 teacher for the purchase of classroom supplies. The Superintendent of Public 35 Instruction shall determine the formulas and methodologies by which such funds 36 are distributed, within this framework, and the permissible uses. The Superin- 37 tendent of Public Instruction may withhold or require the return of such 38 funds, in the case of any school district or public charter school that is 39 using or is proposing to use such funds in an impermissible manner. 40 SECTION 8. That Section 33-1004E, Idaho Code, be, and the same is hereby 41 amended to read as follows: 42 33-1004E. DISTRICT'S SALARY-BASED APPORTIONMENT. Each district shall be 43 entitled to a salary-based apportionment calculated as provided in this sec- 44 tion. 45 1. To determine the apportionment for instructional staff, first deter- 46 mine the district average experience and education index by placing all eligi- 47 ble district certificated instructional employees on the statewide index pro- 48 vided in section 33-1004A, Idaho Code. The resulting average is the district 49 index. Districts with an index above the state average index shall receive 50 their actual index but not more than the state average plus .03 for the 51 1994-95 school year, and shall receive their actual index but not more than 3 1 the state average plus .06 for the 1995-96 school year, and thereafter shall 2 receive their actual district index. The district instructional staff index 3 shall be multiplied by the instructional base salary of $24,62325,231. The 4 amount so determined shall be multiplied by the district staff allowance for 5 instructional staff determined as provided in section 33-1004(2), Idaho Code. 6 The instructional salary allocation shall be further increased by the amount 7 necessary for each full-time equivalent instructional staff member placed on 8 the experience and education index to be allocated at least the minimum salary 9 mandated by this section. Full-time instructional staff salaries shall be 10 determined from a salary schedule developed by each district and submitted to 11 the state department of education. No full-time instructional staff member 12 shall be paid less than $31,000750. If an instructional staff member has been 13 certified by the national board for professional teaching standards, the staff 14 member shall be designated as a master teacher and receive $2,000 per year for 15 five (5) years. The instructional salary shall be increased by $2,000 for each 16 master teacher. The resulting amount is the district's salary-based apportion- 17 ment for instructional staff. For purposes of this section, teachers qualify- 18 ing for the salary increase as master teacher shall be those who have been 19 recognized as national board certified teachers as of July 1 of each year. 20 2. To determine the apportionment for district administrative staff, 21 first determine the district average experience and education index by placing 22 all eligible certificated administrative employees on the statewide index pro- 23 vided in section 33-1004A, Idaho Code. The resulting average is the district 24 index. Districts with an index above the state average index shall receive 25 their actual index but not more than the state average plus .03 for the school 26 year 1994-95, and shall receive their actual index but not more than the state 27 average index plus .06 for the 1995-96 school year, and thereafter shall 28 receive their actual district index. The district administrative staff index 29 shall be multiplied by the base salary of $35,816. The amount so determined 30 shall be multiplied by the district staff allowance for administrative staff 31 determined as provided in section 33-1004(3), Idaho Code. The resulting amount 32 is the district's salary-based apportionment for administrative staff. 33 3. To determine the apportionment for classified staff, multiply $19,783 34 by the district classified staff allowance determined as provided in section 35 33-1004(4), Idaho Code. The amount so determined is the district's apportion- 36 ment for classified staff. 37 4. The district's salary-based apportionment shall be the sum of the 38 apportionments calculated in subsections 1., 2. and 3., of this section, plus 39 the benefit apportionment as provided in section 33-1004F, Idaho Code. 40 SECTION 9. Of the moneys appropriated in Section 3 of this act, up to 41 $50,000 may be expended by the Superintendent of Public Instruction to defray 42 the costs associated with a Teacher Performance Evaluation Task Force. The 43 Superintendent of Public Instruction shall appoint, convene and provide admin- 44 istrative support for said task force. The task force shall include the fol- 45 lowing members: 46 (1) Three superintendents, principals or public charter school directors; 47 (2) Three members of school district boards of trustees or public charter 48 school boards of directors; 49 (3) Three classroom teachers, at least two of whom must be members of 50 teacher associations. 51 The charge of this task force is to develop minimum standards for a fair, 52 thorough, consistent and efficient system for evaluating teacher performance 53 in Idaho, and to present its written recommendations to the Governor, State 54 Board of Education, and the standing Education Committees of the Idaho Legis- 4 1 lature by no later than January 30, 2009.

This is the Fiscal Year 2009 appropriation for the Division of Teachers portion of the Public Schools budget. The pieces of the Public Schools budget that are part of this division’s appropriation include: 1) The teachers’ portion of the salary-based apportionment formula; 2) State paid employee benefits for teachers, which include PERSI and FICA; 3) Funding for Master Teacher awards; 4) Early Retirement Program payouts for teachers; 5) Funding for training teachers to work with Gifted & Talented students; 6) Funding directed to teachers for the purchase of classroom supplies; 7) One-time funding for a teacher evaluation task force; and 8) The Teachers’ portion of federal pass-through funding to local school districts.
This budget adds funds for an increase of 170 new full-term support units, increases the minimum teacher salary from $31,000 to $31,750, and provides a 2.5% increase in the teacher base salary from $24,623 to $25,231. |
