  2    RELATING TO APPROPRIATIONS TO THE  DEPARTMENT  OF  AGRICULTURE;  REDUCING  THE
  3        APPROPRIATION  TO  THE  DEPARTMENT  OF  AGRICULTURE  FOR FISCAL YEAR 2009;
  4        REDUCING THE APPROPRIATION TO THE DEPARTMENT  OF  AGRICULTURE  FOR  FISCAL
  5        YEAR  2009;  APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF AGRICUL-
  6        TURE FOR FISCAL YEAR 2009; APPROPRIATING ADDITIONAL MONEYS TO THE  DEPART-
  7        MENT  OF  AGRICULTURE FOR FISCAL YEAR 2008; AND DECLARING AN EMERGENCY FOR
  8        SECTION 4 OF THIS ACT.

  9    Be It Enacted by the Legislature of the State of Idaho:

 10        SECTION 1.  The appropriation made  in  Section  1,  House  Bill  613,  as
 11    enacted by the Second Regular Session of the Fifty-ninth Idaho Legislature, to
 12    the  Department  of  Agriculture is hereby reduced by the following amount for
 13    the designated program according to the designated expense  classes  from  the
 14    listed funds for the period July 1, 2008, through June 30, 2009:

 27        SECTION  2.  The  appropriation  made  in  Section  1,  House Bill 613, as
 28    enacted by the Second Regular Session of the Fifty-ninth Idaho Legislature, to
 29    the Department of Agriculture is hereby reduced by the  following  amount  for
 30    the  designated  program  according to the designated expense classes from the
 31    listed fund for the period July 1, 2008, through June 30, 2009:

 39        SECTION 3.  In addition to the appropriation made in Section 1, House Bill
 40    613, as enacted by the Second Regular Session of the Fifty-ninth Idaho  Legis-
 41    lature, there is hereby appropriated to the Department of Agriculture the fol-
 42    lowing  amount to be expended for the designated program according to the des-

  1    ignated expense class from the listed  fund  for  the  period  July  1,  2008,
  2    through June 30, 2009:

  8        SECTION  4.  In  addition  to the appropriation made in Section 1, Chapter
  9    266, Laws of 2007, there is hereby appropriated to the Department of  Agricul-
 10    ture  the  following amount to be expended for the designated program to reim-
 11    burse the Department of Fish and Game for  costs  related  to  the  escape  of
 12    domestic  elk  according  to the designated expense class from the listed fund
 13    for the period July 1, 2007, through June 30, 2008:

 19        SECTION 5.  An emergency existing  therefor,  which  emergency  is  hereby
 20    declared  to exist, Section 4 of this act shall be in full force and effect on

Statement of Purpose / Fiscal Impact


Statement of Purpose

This is a trailer appropriation to the Department of Agriculture for four purposes.

First, the bill provides a supplemental appropriation in the amount of $60,800 to reimburse the Idaho Department of Fish and Game for personnel costs, travel, and supplies authorized under Executive Order 2006-32 dated September 7, 2006 to respond to the escape of domestic elk from a ranch in Eastern Idaho. These costs were paid with sportsmen’s dollars and should have been paid by the Department of Agriculture, the agency responsible for administration of the domestic elk program.

Second, the FY 2009 Department of Agriculture budget was set with the Appropriation for the Ag in the Classroom program intact. Because H426 made the Ag in the Class Fund continuously appropriated and took the program off-budget, the Department of Agriculture has no use for the FY 2009 appropriation from that fund. This action cleans up the appropriation bill by removing $38,500 in spending authority from the Agriculture in the Classroom Fund and $25,300 General Fund that had also been approved for support of the program.

Third, the Department of Agriculture Budget was set with the appropriation for the Agricultural Smoke Management Fund intact. Because H557 transferred all remaining balances out of the fund at year end and repealed the fund, the Department of Agriculture has no use for the FY 2009 appropriation from the Smoke Management Fund. This action would clean up the appropriation bill by removing $114,800 from personnel costs and $106,100 from operating expenditures for a net reduction of $220,900.

Fourth, S1388 increased the grant amount available for planning and development of eligible intermodal commerce authorities from $25,000 per year to $100,000 per year. This grant will be paid from the interest generated from the $5 million loan program. This bill gives the Department of Agriculture $75,000 in additional spending authority to make a full award.

Fiscal Note

This appropriation bill impacts two fiscal years. The fiscal impact in FY 2008 is $60,800 one-time from the General Fund. The fiscal impact in FY 2009 is a reduction of $25,300 in General Fund moneys and $184,400 in dedicated funds for a total ongoing reduction of $209,700.
