]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 39 BY ENVIRONMENT, ENERGY AND TECHNOLOGY COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE IDAHO 3 BUREAU OF OCCUPATIONAL LICENSES PERTAINING TO RULES OF THE BOARD OF DRINK- 4 ING WATER AND WASTEWATER PROFESSIONALS. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, the Legislature is vested with authority to reject executive 7 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 8 that the Legislature finds that the rules are not consistent with legislative 9 intent; and 10 WHEREAS, it is the finding of the Legislature that a certain rule of the 11 Bureau of Occupational Licenses pertaining to Rules of the Board of Drinking 12 Water and Wastewater Professionals is not consistent with legislative intent 13 and should be rejected. 14 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 15 sion of the Fifty-ninth Idaho Legislature, the House of Representatives and 16 the Senate concurring therein, that IDAPA 24.05.01, Rules of the Board of 17 Drinking Water and Wastewater Professionals, Section 300, relating to Require- 18 ments for License, Subsection 02, second sentence, only, and not any paragraph 19 thereunder, Rules of the Idaho Bureau of Occupational Licenses, as adopted as 20 a pending rule under Docket Number 24-0501-0701, be, and the same is hereby 21 rejected and declared null, void and of no force and effect.
STATEMENT OF PURPOSE
RS 17760
This concurrent resolution would reject a sentence in a certain
subsection of a pending rule of the Bureau of Occupational
Licenses pertaining to the Rules of the Board of Drinking Water
and Wastewater Professionals. The effect of this resolution, if
adopted by both houses, would be to prevent the second sentence
in the subsection of the agency rule from going into effect.

This concurrent resolution has no fiscal impact.
