                             HOUSE CONCURRENT RESOLUTION NO. 45

                                 BY STATE AFFAIRS COMMITTEE

  1                               A CONCURRENT RESOLUTION
  2    STATING LEGISLATIVE  FINDINGS  AND  AUTHORIZING  THE  LEGISLATIVE  COUNCIL  TO
  3        APPOINT AN INTERIM COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF PROPERTY
  4        TAXES AND PROPERTY TAX REVENUE EXPENDITURES.

  5    Be It Resolved by the Legislature of the State of Idaho:

  6        WHEREAS, rising property taxes are a major concern to residential property
  7    owners; and
  8        WHEREAS,  it  is apparent that short-term or emergency reactions to rising
  9    property taxes result in ill-considered, piecemeal and counterproductive  mea-
 10    sures; and
 11        WHEREAS,  the  Idaho Legislature has had many measures introduced over the
 12    past several years regarding the property tax in an effort to  provide  relief
 13    to payers of the property tax; and
 14        WHEREAS, it is the desire of the Legislature that a property tax structure
 15    should encourage economic development, not hinder it; and
 16        WHEREAS,  it  is reasonable to review expenditures of property tax revenue
 17    in order to consider property tax relief for the citizens of this state; and
 18        WHEREAS, a large measure of the operational cost burden  of  this  state's
 19    criminal  justice, juvenile justice and court systems is borne by property tax
 20    revenues, including costs associated with these systems' personnel, operations
 21    and facilities; and
 22        WHEREAS, in order to provide property tax relief, it may be appropriate to
 23    find an alternative funding mechanism for this state's criminal justice, juve-
 24    nile justice and court systems; and
 25        WHEREAS, it is the goal of the Legislature to provide reasonable  property
 26    tax relief to the citizens of this state.
 27        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 28    sion of the Fifty-ninth Idaho Legislature, the House  of  Representatives  and
 29    the  Senate  concurring therein, that the Legislative Council is authorized to
 30    appoint a fourteen member committee to undertake and complete a study  of  the
 31    state's  property tax system, including expenditures of property tax revenues,
 32    with a goal of determining if such expenditures are reasonably  borne  by  the
 33    state's property tax or if such expenditures might more reasonably be borne by
 34    other  revenue  sources.  The principal goal of the committee shall be to make
 35    recommendations that provide Idahoans with property tax relief, encourage eco-
 36    nomic development, meet the needs of local units of government and further the
 37    improved administration of the state's criminal justice, juvenile justice  and
 38    court  systems.  The  Legislative  Council shall determine the membership from
 39    each house appointed to the committee and shall  authorize  the  committee  to
 40    receive  input, advice and assistance from interested and affected parties who
 41    are not members of the Legislature.
 42        BE IT FURTHER RESOLVED that nonlegislative members of the committee may be
 43    appointed by the cochairs of the committee who are appointed by  the  Legisla-
 44    tive  Council.  Nonlegislative  members of the advisory committee shall not be

  1    reimbursed from legislative funds for per diem, mileage or other expenses  and
  2    shall  not have voting privileges regarding the committee's recommendations or
  3    proposed legislation.
  4        BE IT FURTHER RESOLVED that the committee shall report its findings,  rec-
  5    ommendations  and  proposed  legislation  to  the First Regular Session of the
  6    Sixtieth Idaho Legislature.

                       STATEMENT OF PURPOSE

                             RS 17858

This resolution authorizes the Legislative Council to establish
an interim committee to study Idaho's property tax system,
including the expenditure of property tax revenues, to determine
if such expenditures might more reasonably be covered from other
revenue sources, and to make recommendations to provide property
tax relief while encouraging economic development, meeting the
needs of local governments, and furthering the improved
administration of Idaho's criminal justice, juvenile justice and
court systems.


                           FISCAL NOTE

Any necessary legislator travel and per diem expense would be
paid from the existing legislative appropriation to the Senate
and House of Representatives.  Funding for staff support and
expenses would be provided from the existing appropriation to the
Legislative Council for the Legislative Services Office.
