]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT MEMORIAL NO. 6 BY HEALTH AND WELFARE COMMITTEE 1 A JOINT MEMORIAL 2 TO THE PRESIDENT OF THE UNITED STATES, TO THE SECRETARY OF THE UNITED STATES 3 DEPARTMENT OF HEALTH AND HUMAN SERVICES, TO THE SENATE AND HOUSE OF REPRE- 4 SENTATIVES OF THE UNITED STATES IN CONGRESS ASSEMBLED, AND TO THE CONGRES- 5 SIONAL DELEGATION REPRESENTING THE STATE OF IDAHO IN THE CONGRESS OF THE 6 UNITED STATES. 7 We, your Memorialists, the House of Representatives and the Senate of the 8 State of Idaho assembled in the Second Regular Session of the Fifty-ninth 9 Idaho Legislature, do hereby respectfully represent that: 10 WHEREAS, the federal survey process through which skilled nursing facili- 11 ties are inspected is a federal process which is not available for significant 12 state deviation or modification; and 13 WHEREAS, the federal survey process was developed in 1987 and was designed 14 for typical residents in skilled nursing facilities at that time; and 15 WHEREAS, the acuity levels of patients now being cared for in skilled 16 nursing facilities are significantly elevated from those of twenty years ago; 17 and 18 WHEREAS, the federal survey process does not allow for trained, experi- 19 enced surveyors to provide consulting of any kind when surveying a skilled 20 nursing facility; and 21 WHEREAS, the punitive and negative design of the federal survey process 22 often negatively impacts the morale, turnover and motivation of the workforce 23 of the skilled nursing facility; and 24 WHEREAS, the costs of the very expensive federal survey process outweigh 25 the benefits; and 26 WHEREAS, the state of Idaho has produced a survey process for assisted 27 living providers which is not punitive, provides for significant consulting 28 and, as current feedback indicates, a confidence building and learning experi- 29 ence for employees of the facility. 30 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 31 sion of the Fifty-ninth Idaho Legislature, the House of Representatives and 32 the Senate concurring therein, that the Idaho Legislature urges the Idaho con- 33 gressional delegation, the Idaho Department of Health and Welfare, the United 34 States Department of Health and Human Services, resident advocate groups in 35 Idaho and industry representatives to negotiate how to improve the survey 36 process in skilled nursing facilities in Idaho and that the Idaho Legislature 37 supports measures to improve quality care in the skilled nursing facilities in 38 Idaho and the Idaho Legislature also affirms our desire to be efficient with 39 tax dollars. 40 BE IT FURTHER RESOLVED that the Idaho Legislature urges the Idaho congres- 41 sional delegation to request support and necessary funding from the United 42 States Congress for a pilot project in the state of Idaho to implement the 43 changes negotiated by the aforementioned groups. 44 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa- 2 1 tives be, and she is hereby authorized and directed to forward a copy of this 2 Memorial to the President of the United States, to the Secretary of the United 3 States Department of Health and Human Services, to the President of the Senate 4 and the Speaker of the House of Representatives of Congress, and the congres- 5 sional delegation representing the state of Idaho in the Congress of the 6 United States.
STATEMENT OF PURPOSE RS 17792 This resolution would compel Idaho's congressional delegation and others to improve the federal survey process for skilled nursing facilities.
